I had a chase manahattan account that was dismissed in court, but now it is showing up on my credit report under Assest Acceptance Corp. What can I do to get this off my credit report? I have already disputed it with the credit bureaus but they wont take it off.
Thanks

Hi RM

Have you sent your dispute letter to the credit bureau through certified mail with return receipt requested? They need to give you the proof of their investigation if your dispute is considered as invalid.

If they have not taken any action within 30 days, a follow up letter has to be sent to speed up the legal process. If you have the proof that supports your dispute, do send it. By this time, they have to give this matter the utmost importance.

If you still don't hear anything from them, send a letter along with its copy to the FTC. This forces the credit bureau to make the necessary updates on your file or remove the inaccurate negative information that is damaging your credit. You can file a legal case with the help of your attorney as per FCRA Section 623 of the fdcpa law.

You also have the provision to add a 100 word statement in your file in such situations when the credit bureaus are unwilling to update your file. Add a note for this account that reflects the inaccurate picture of your credit file.

You can also write letters to the collection agency that is reporting this account to the credit bureau. They are required to either validate the debt or remove the negative information from your file by contacting the credit bureau. Make sure that you have taken consultation from an attorney that specializes in the lawsuits of FDCPA and FCRA violations.

Please do keep up updated on this matter.
