Hi! First off, if you read through the forums here and also do a search on the internet, you will find that 'Encore' has a reputation as being a known bully and harrasser. From what I have read and understand, they have broken many rules in their 'collecting technique'. Many people like yourself complain of threats and harrassment.
Its my experience with what I've been told and been through, that once you ask for validation, they're not to bother you until they provide that validation. Encore can not take you to court nor can they do a garnishment through your employeer. That is court ordered by a judge only, and this case has to go before a judge before that can be done. They are trying to use scare tactics on you to get you to pay.
Encore can not do this themselves, however, they can send the account back to the original creditor that you had the debt with, and recommend to them that they take you to court and garnish your wages. Once it goes back to original creditor, its their call on what to do next, if anything. Sometimes they will get the account back and turn right around and send it out to another collection agency, and try it that way until they get luck on collecting.
You have asked for validation, you made your move, now its their move to provide you with that. You don't have to pay them a dime until they do.
As far as calling your work, if you asked them not to call you and they still do, they are breaking the law. Which is not unusual for this company, they are known for that too.
I have an account that is with Encore, right off the bat, I sent a validation request. This was a few months ago. They've yet to send validation but I have also stopped hearing from them. I also made it clear in that letter that I respond to written correspondence ONLY. NO PHONE calls to my home or my job. That I do not do business over the phone and DO NOT accept phone calls. If they want to talk to me, they'll have to do it through written correspondence through the USPS only. Once getting this, they haven't called or wrote me since. I hear of so many people having trouble with them but so far,they have left me alone. Maybe they're having trouble with getting the validation, I'm not sure what it is.
