I am experiencing a serious problem w/ a collection agency. The contract date is 1988, and I responded to a court summons re: this invali debt. Unfortunately, I didn't know to ask the judge to dismiss the case, and she did not do so to my knowledge. I sent a cease and desist letter and the calls have gotten very nasty, and not to my home but that of my mother. My father passed away 10/5 and they are terrorizing my poor mother. I notified them by certified letter that the # their calling is not mine but they refuse to stop. How can I eliminate this problem? Any advise? Charles

I am sorry about you going through a very sad situation. Have you paid anything towards this account recently? If so, you might have to check this account as the SOL is perhaps renewed.
If you have not paid anything, then this debt is disputed. Send a letter to the CA explaining that the debt is out of the SOL period and you have already sent a cease and desist letter for stopping all collection calls. They are violating the laws by calling you after receiving the cease and desist letter. Do you have the receipts of your certified letter sent last time? You might wish to show it to your lawyer for further actions.
