Contact the attorney general office in Illinois and file a complaint against them. I dealt with them about 3 weeks ago and had to call the sheriffs department and file a complaint against them. John Puckett was the person who was issuing threats. I have filed a complaint against them and waiting to hear back from Attorney General in Illinois. They use to go by the name Aylon Technologies til they got into so much legal trouble and they changed their name to First Credit of America. This information was givin by the attorney general in Illinois.

Try to be pro-active while you are dealing with First Credit of America regarding wage garnishment. They have to obtain a court ordered judgment before your wages are garnished. Legally speaking, you will be asked to appear in the court before this action takes place. If this has been done so, your wages cannot be garnished more than 25 percent of your disposable income.

Does anybody know anything about First Credit of America? I got a call on the evening of 11-21-05 from a Phil Shaw telling me he was calling to collect a debt on behalf of his client for the amount of $984.99 due from charges made to a Visa Credit card ending in ----giving the last four digits. I told him, I did not own a card nor have I ever owned a card with the #'s he gave me. I asked who the charges were made to and he stated it was an adult chat line charge...I stated I am an elderly woman and have never called an adult chat line in my life nor would I ever consider doing so in the future. He gave me a phone # the charges were coming from with a out of town address I have never lived at. I also requested the name of the Visa card company and he stated he did not have that information...just the credit card numbers and the ph. # and address of the card holder. I did not understand if the phone # where the calls were coming from creating the charges on the card did not match the phone # where he reached me at which was in opposition and contrary why he was so harsh and rude with me about paying this debt weather I felt it was mine or not cause it was my credit it was effecting. I did a reverse check on the phone # and came up with a mans name who is 26 yr. old and local to my city. What must I do from here? Phil Shaw states after we hung up from this call this debt will be turned over to Equifax, Experion, & Transunion and I could fight it out with them unless I paid him the $984.99 Right Here Right NOW!

It might have happened that the debt collection agency has mistaken someone else's identity with you. This is quite acceptable but the situation worsens if the agency does not back up after pointing out the mistake. At this stage you should exercise your consumer rights as per the fdcpa law and keep them away from you.
Ask the company to validate your debt as it is your legal right to know the complete details of the accounts. If it is a legitimate one, they will be able to give you all the necessary information. Otherwise, you can take legal actions against them if they report negatively to the bureaus.
Give your letter the most legal importance and it should be clearly stated that you refuse to pay it unless you are served with the necessary details. Also, do mention that you refuse to be contacted at phone during this period and all correspondence should be done only through mail.
Violation of any of the mentioned federal laws will put you in charge of filing a class action lawsuit against them. You might be interested in recording the telephonic conversations for gathering legal proof. Later, you can show it to your lawyer for further guidance.
Lynn, do send your letter through certified mail with return receipt requested. This is most important because you will have a proof of every action made. This will also ensure that they have received your letter and it was their turn to give you the necessary details.
