Here is my orignal post

Can anyone give me advise on the laws in Florida. I too have been caught up in the web on internet loans. Right now I have 10(I didnt even realize I had taken out this many) loans out and its killing me, there going into my account on days they know are not my paydays and my bank is killing me with fees because the money is not there, any help is greatly appricated.
The companies I used are

Hi. Welcome to the community. :-) For immediate results, you will probably have to close your bank account and open another one at a different bank. You will also probably want to get your employer to pay you with a "live" check on Friday so that you can take it to the bank and cash it yourself. This will keep the ipdls from getting to your money. BUT, this is only the first step. Please answer Kash's question about the extensions. Also, try to relax because there is a way out of this. :-)

No. They are most likely not legal or licensed anywhere. This sounds like an idle threat to scare you. Also, remember that per your laws, criminal action is prohibited. I think that you need to send all of the pdls a cease and desist letter along with a wage assignment revokation letter so that they don't try to send something to your hr department to have a part of your wages sent to them. This is completely revokable, and I don't even know if you signed one. But, to be on the safe side sending something saying "I revoke all wage assignments that may have been previously authorized" will keep them from being able to get anything. They will try these kinds of tricks, so it is just better to be prepared for them.

Also, per your state laws, I see that you should only be charged $15 per $100. In most cases, you were charged $20-$30 per $100. Also, rollovers are not permitted, per your state's laws. If you were allowed to extend your loan, then the laws were broken anyway. So, add up all that you have paid to each pdl and let us know what you have come up with. You probably don't owe nearly the amount that you think you do.

Kash, since the pdls are basically doing unauthorized transactions (being that they are deducted on days that Ishmael didn't authorize them to be deducted on), do you think he should make a report to the bank regarding unauthorized transactions? This might help to recoup some of the fees he's incurred. Just wondered what you thought of that. :-)

Ahhh! I get it now. (I'm a little dense today!) Plus, I wasn't sure exactly how that whole unauthorized debit thing worked. So, let me get this straight...If the pdl is authorized to debit, then the date that they debit on is not relavent, even if a date is specified and agreed upon by the consumer and the pdl? I feel kind of dumb asking this, but like I said before, this whole authorized/unauthorized thing confuses me a little... :roll:

That's true. If he didn't inform them then it would be authorized...I'm sorry to have kept asking about it. I get it now. I think I was misreading what was being said. Looking back it makes alot more sense to me now. In fact, I had to let one of my lenders know that a pay date had changed for me, too, and it was like an act of congress to get them to change the debit date! I had to actually send them something from my hr dept. stating that I was not going to get paid until a certain date! (It was like a two day delay due to a weekend) I tell you, some of these ipdls are NOT easy to work with!

I never change my pay date, they were going in every two weeks on fridays like I agree for them to do, but MTE decided along with cashnet that they will go in the thursday following my payday and try to take the entire amount (with 3 or 4 debts,so the bank fees are piling up) along with their fees. Im on hold know with the bank I'll respond back once I talk to someone

I'm just jumping in here to tell you, ishmeal, that you need to go personally to the bank and speak with the branch manager. Do not call the customer service number. Do not speak with a teller. You need to go to the branch where you opened your account and speak to the manager there. That is the only person that can help you regarding your bank account. Not customer service. Not a bank teller.

Thanks guys, I went to the bank and talked to the manager come to find out she also was a victim of payday loans so when I told her my situation she was more than glad to help me. Instead of blocking the ach debts she close my account and reopened another one for me. Now im going to start sending out those letters to the blood suckers to stop them from trying to contact me or my payroll department. Do you guys have any copies of letters you sent that I can use. I really appricate the help and advise I getting from this site. In the words of the baby turtle Squirt from the movie "Finding Nemo". YOU ROCK DUDE!!!

Hello guys, I have some great news I sent out my letters I've gotten the signed return receipt so I know they recieved them all except paydayloan-yes(because not realizing, I had a P.O. Box address for them) but so far Apple Fast Cash and Loan Shop have sent me letters saying they will cease with all collection attemps and my accounts are paid in full. Does anybody have a valid address for Paydayloan-Yes, I would like to resend them my letters, also does anyone have the address for USA payday loans they contacted me via phone and offer a settlement of $150.00 to be sent via western union, even though the loan was only for 150.00 and I already paid $50.00 should I just pay them or fight them as well.

Also do the blood suckers have access to other payday loans?,Because in the letter from Apple Fast Cash they listed all of my loans from other companies and said the were closing my account because they could see I was over extended (like they weren't breaking any laws and was doing me a favor). Just wondering can they access that information legally.

ishmeal! Great news! I can see what I can find for PayDayLoanYes. I'll do a search. USA Paydayloans? Do you have their phone number? I can do a search on them also. Now regarding them and their settlement, if you just want to "be rid of them", by all means, settle! However, the cost of the money gram is going to come from you & you have already paid them $50. I wonder if you can "counteroffer" for $100 to settle, which would be subtracting your $50 pmt & also tell them that it would also make up for the money gram expense?? Am I being petty? But, hey, $100 is actually what you owe them. And money gram does cost. But, it's up to you. If it's worth the $150 to say "goodbye", then do it. Your decision! Let me see if I can find anything on the two pdls you need info. one. I'll try! :wink:
