Maybe some of you remember that I received a summons to small claims court last month from HSBC. My contention was that, yes, I owed them some money but they refused to respond when I sent a certified letter stating that I wanted to bring my account current.
Well we sat at a table in a back room with a mediator and the lawyer said that they wanted 600.00 plus court costs and attorney fees. I said why should I pay the court costs and attorney fees when they could have settled this without going to court and showed him the letter with the confirmation. He said they would take a 20% off settlement If I paid in full right now. No. He said let me make a phone call. He came back and said that Bray & Lunsford had a phone log that they called 20 times and I did not return their calls. They also sent a notice by mail. I never heard that name before yesterday. Bottom line was I pay 50.00 per month or we go to trial where I would have possibly gotten the amount reduced but I would have a judgement against me for a lesser amount. I would still be a judgement. Oh well I tried my best.
Lesson learned. If someone calls and leaves no message or a "Please call Mr. Jones" message the "phone log" can be used against you.


Humm... ok i've read this three times and guess i dont' remember the "whole" story.. How much did u actually owe them? And have u tried to settle this with them before this court date??
I mean we can't second guess ourselves in life and of course hind sight is always 20/20.... You did what u felt u needed to do at the time frog and i imagine it could have been a lot worse but i'm not sure what the call log has to do with any of this?? Especially from a company u've never heard of.... These CA's are sneaky!!

I actually owed them 600.00. I tried months ago to get them to tell me how I could bring my account up to normal. It was still in the hands of HSBC. HSBSC would not respond. Somewhere along the line this Collection Attorney got it and apparently was leaving those "its important that you call" numbers with no name. I never call them back. Well that was their proof that they tried to settle. Their name was not even on the court papers. It was pay up or go to court. I do not need a judgement on my record for any amount.

I guess I'd take that offer of $50 a month and run with it, Frogpatch. It doesn't appear it will get any better.

I'm going to mention this to my sister, who is dealing with National Enterprise calling her 8-10 times a day, demanding full payment, won't make payment arrangements, and is threatening to take her to court. I've told her I don't think they will, but if they do, the worst that will probably happen is the judge or mediator will set up payments she can afford. Your case is a prime example.

Well a credit card with a 300.00 limit is costing me 900.00 but at least there is no judgement. I was happy when I saw the offer from Cash Net and now the idiots are saying they didn't send it. I am livid but I will refrain from using my collection of livid words and phrases with respect to this site.
