I wanted to provide everyone with some helpful information regarding wage garnishments. I deal with this on a daily basis. I also deal with the creditors calling for information on a daily basis as well.

1. Your employer should not give out any information over the phone. The requests for information should be made in writing, provided you are aware of this.

2. Your wages should not be garnished unless it is done so by a court order. A company simply sending info to your employer is not enough, a court order should be in place before an employer can deduct from your wages.


3. At the same time, a garnishment can only be reduced by you going through the appropriate channels i.e, going through the creditors, or going back to court.

I hope this information is helpful to some people. These are the types of call that I deal with on a daily basis. I do have creditors or people yell at me because I will not give out any information. But by law, I do have to follow these rules.


thanks for that helpful information because i needed to know that so hopefully none of my payday loans will be garnished out of my wages without my knowledge i mean really need to know how i can pay these places back as well anyways thanks for the helpful information

Could someone please reply to this. I am getting nervous about this company, they have told me several times they will prosecute me over $390.00, even when I had to close my checking account because of all the unauthorized payment. I want to pay them off, but when I asked for a summary, I was told I would get it once I paid them the $390.00. Do I need a lawyer, I never been prosecute before? Please respond, someone.
