I just received a call from 913-825-1200 (caller ID) or 800-351-8820 (number he gave me) and was threatened and told that I embezzled money from his company and he needed to speak with my supervisor in order to take care of this debt. When I would not give him that information, he said that I had 1 hour to come up with 647.50 or there was going to be a serious problem. He told me that I needed to call my friends and family and borrow the money from them. I know that I owe the money to Geneva Roth Ventures, but I can not be getting these stressful calls at my work anymore.
So I have been reading on this site and know that these collection companies can not send me to jail no matter what they threaten. I would like to get a letter that I can fax them, so that they will not call me at work anymore. Any infomation on this would be greatly appreciated. Thanks

Okay, I have a question for anyone. I recieved a call from this company day before yesterday, telling me that I owe over 1,800. I told her that this account was paid out in Sept 07, so I asked if she would forward me a breakdown of this amount. She is now saying that they are closing my file due to refusal of payment, which is totally not true! I explained to her that I needed some sort of proof that I actually owe this amount. What can they do? 8)

I closed my bank acct, after sending de-authorizing forms. I opened a new acct, at a different bank, and 3 months later, there's a debit for $400 to them. How did they get new info--and even if they did, any earlier paperwork was for old acct, they can't use that for a diff acct at a diff bank---can they???
Fraudulant Company Geneva Roth or aka GRC Funding
I borrowed a small payday loan from Geneva Roth Capital aka GRC Funding in September of 2007 for 400. I never received anything from this company asking me to renew my loan or to payday down the loan; when I tried to call the number for GRC on my bank statement the number was disconnected; there is not a website in which to contact this company. In March of 2008 I stopped through my bank an ACH payment for 120 since at that time I would have paid over 800.00 for a 400.00 loan. I was then and only then contacted by GRC on April 4, 2008 at my work where I was told my outstanding balance is 1,000 and if I did not enter into a payment arrangement there would begin proceedings for going to court. I questioned why I owed 1,000 and not the original 400 with interest of 120. I was told I had only been extending the loan the last 7 months and it would never begin to paydown until I paid more than 120 with each payment. I would have had to call, fax in a pay down form or e-mail GRC to do so. I explained how I was not able to reach them and was told they had made contact with me by mail and phone. I asked at what address or phone since until now I had never heard from them, the gentlemen I spoke with became loud and accusative telling me that I had agreed to the terms of the loan with my signature and I should have made contact if I had wanted to paydown the loan. Since he avoided answering my questions I asked to speak to a manager. I was transferred to Dia Holley where she gave me the same run around that I had only been extending the loan and did not answer my question about the disconnected phone number or lack of website. Regretfully I agreed to a payment arrangement with her for the 1,000. We agreed upon 4 payments of 250 with one I paid right then (this posted to my account right then) which would leave 3 payments. I asked for this agreement in writing and received this through e-mail where she gave me her direct extension and phone number. On 4-7-08 another debit was taken from my account in the amount of 520 that I did not authorize which means I have now paid GRC over 1,500, in doing so my account is overdrawn and it has caused many more NSF charges leaving me without funds to pay my outstanding bills. I contacted Dia 4-8-08 at her direct extension, I explained the 520 and she put me on hold, where she then hung up on me, I called back and she again hung up on me. The third time she called me back and told me I would have to send her a bank statement and she would reverse the debit but she could not guarantee me about the NSF charges or if GRC would not continue taking funds out of my account in error. I found it difficult to speak w/ her and asked to speak to someone above her to find answers to my questions she again hung up on me. Not knowing if I will have to continue paying more for this loan I need legal advice and how to take action. I have considered closing my bank account but I am not sure how doing so will affect my credit with this company if it hasn't already. Any advice or help would be greatly appreciated. Thank-you...

I took out a payday loan for $300 last July. I paid the 90.00 for a couple of months and they kept debiting my account. I closed the account and now in May 2008 they say I owe 1900.00. I recevied threatening calls from Smith Watson Haynes saying they will pursue the matter. Is this legal in Texas?

hello, i am dealing with them because of a loan point usa loan i have taken. i know that they're horrible and they're the biggest threats of all the loans i have ever taken (not to underestimate VIP, who just vanished for now!). right now they're idle.. they already called my to discuss my C & D letter (huh??) but i hung up on them. they responded to my bbb report with same crazy stuff, which i responded not resolved. i still owe them $500.. i live in NJ and they're not legal here though. I am def. up to destroying them! :)

it does not matter that geneva roth is a first party collector. the fdcpa still applies. i did first party collections for years and these companies do not addhere to the fdcpa like most second and third party agencies. however harrassment is still harrassment and violation of someone privacy rights by disclosing debt information to an third party, ans geneva roth can still get into a lot of trouble, attorney general fdcpa violations and so on. i have been in the industry and i have seen first party collection agencies have to bite the bullitt and forgive a debt and pay punitive damages, court cost attorney fees. debtors are becoming more educated ans aware of their rights. everyone owes debt even collectors, but that gives no one the right to stalk and humiliate someone and threaten them. also collection agencies can not state something that they can not or will not do.

Closed my accounts and opened new one, and low and behold they took everything out of my checking account this morning. So I wake up this morning and there is a pending transaction in my new bank for 400 and it says next to it Genva Roth Vent. I in no way gave anyone permission to take this money and now My husband is freeking out about it because we have a 600 rent check coming through tonight. The posts here prove that this company is hurting a lot of people and needs to be shut down. I know in some states they are legally giving loans but even than I'm sure they still break laws in collecitng the money owed.

The fdcpa does not apply to companies collecting their own debt. It applies to collection agencies collecting other parties' debts. So, a company that is collecting money that the company is owed, does not have to adhere to the FDCPA requirements. I thought that was part of a Jedi's training. I advise all, be careful what you take from message boards because you might end up looking like a fool making threats that are baseless, especially to a company that is in the business of collecting their own debt (they are well-versed in the FDCPA, FCRA, UCCC, etc.).

i will ignore the previous two posts and say that it is key to send this mostly illegal pdl group an ACH revocation letter.send it
certified mail return receipt.save this letter and the receipt when they sign for it.this place is notorious for debiting accounts years after they are paid or defaulted.if you send the ACH revocation letter,it is fraud for them to attempt to debit after they recieve the letter.

I filled out for a loan on the computer and 2 days later $ 500 in my account, from GRC. They never sent anything to me to sign that I agreed to this loan, I never esigned anything, now my last 2 paychecks 150.00 was taken totaling (300.00). I called there and was asked my account number, I don't know what it is. The girl I spoke to was very rude to me and well you signed the document, and I told her no I did not. She said I'm looking right at your esignature. I told her I wanted a copy and she put me on hold next thing I knew I was diconnectd. I called back and same stuff happened again, but I was not hung up on. This time I was told why am I disputing these charges and I said I never signed or agreed to anything fom this company. She stated my balance was 500 for the loan and 150 for the interest to keep it open. There telling me I owe $650.00 and they already have taken 300. What can I do. I live in CT. Please someone help me. :(

I also had Geneva Roth and they were difficult to deal with, I finally settled with them through the BBB and ended up having my account marked PIF, I was hoping for a refund, but that was just as good. I ended up closing my checking account because they tried to put through a paper check, which my bank reversed for me...but finally they went away...
The first thing I would do is to close your checking account, I would then send them a ACH revocation letter and report them to the BBB, CT Attorney General, the person I was working with was Lorrie Adeyemi and report them to the FTC. You can also send them a cease & desist letter, but I'm not sure how much good it will do, some companies will abide by it and some won't...I was able to get rid of them within 2 months after my payment to them was returned.

i would never intentionally give anyone false advice. This company has given me a loan in a state where they are prohibited. that would make them a company that engages in illgeal activities. Period. I know for some states, they are legal but one must know their own state's laws. This company is in no way above breaking laws and really needs to be reported everytime they break a law. Also, I know that they are the original collectors but I'd report them just for yelling at me! Call me petty, but I'm looking out for others dealing with them and would never give false info to anyone intentionally.

Approx a year ago, I had to take out a payday loan. I had to close my bank account do to fraud and totally forgot to about the loan. I haven't hear anything from them to day. I opened a new bank account at a new bank and had to apply for a new loan last night. The funds went into my account last night, but a withdrawl from Geneva Roth also came out. When I called Geneva Roth and asked how they were able to obtain my new account information I was told it didn't matter, but what did matter was the fact that I owed them money and she wouldn't tell me where she got my account number from and that she was legally able to withdrawl funds from ANY account from my original contract. Is this true? Can they just pull funds from ANY account at ANY time that they choose to? Thanks for your help?

that is why i advised if you revoke ACH debit authorization.keep it and give it to your current bank too.they do have a clause in there contract illegal or not that gives them that supposed right.to debit any account.if you draft that letter and give it to your bank.it makes it much easier to get funds back that GRC attempts to take out.that ACH revocation letter is important when dealing with GRC.

please listen to paulmergel - this company does not stop. i've been trying to settle with them since april and they are so greedy (they want double what i borrowed - and they're prohibited in my state! they also refuse money orders). i could have paid them what i owed by now but they got nothing so far because they're greedy.

Thank you for your advise. After fighting with my bank, they finally figured out that GR had no authorization to withdrawl funds from that account and refunded the money. They also placed a stop payment on our account that will stop GR from withdrawing funds from my account without my permission again. So now I am going to assume that the harrasing phone calls at work and on my cell will be starting again and I am oh so excited...not! I don't even know if I owe them the money as I did pay off a loan and I"m thinking this is it...and...since they won't give me additional information it will be a while before I find out. I guess I'll just play the waiting game and if and when they do call again, I will get a name and send a letter requesting proof of debt.

I too am having trouble with this company. I originally borrowed $200 from them back in 2005. I did not get the loan repaid right away and they continue to take money out of my bank account to this day. They have already taken almost $600 out of my bank account and they say I still owe them $400 just in non-sufficient funds fees. I don't believe this is legal but I don't know how to stop them from taking money from me. My bank won't do anything about it. I keep having to make stop payments with my bank which costs me $30 everytime I do it.

If your affected by this company send an email to 'uag@utah.gov' describing what has happened to you. I have open complaints with the Utah BBB, the State Attorney General, and the FTC. This company uses fraudulent business practices, such as modifying contracts after signed electronically. They changed the due dates on my loans and then sent me to collections AFTER I had repayed the loan. Soemthing needs to give with these people. Email all three of these agencies today......

I am wondering about this company because I did take out a loan with them and asked for them to just take out the extension fee and they took out that plus $50 more so I stopped payment on thatdollar amount and then they tried to take out 199.98 and I stopped that and then they told me that thier checkk recovery system will keep debiting my account and charge $30.00 extra every time until thayget there money. I wish I had some actual names of the check recovery dept?

In attempting to get a payday loan "somehow" this site "TOOK" money out of my account. Be careful...I hit all of the NO check marks and they still took the money!!!! they must be licensed in the state the borrower is in.what state are you in?some states and the number is shrinking allow the company to be licensed in general,but for the most part they have to be licensed in the state of the borrower.i know they not licensed in IL.

Uh....you might want to re-think that....all CREDITORS must abide by fdcpa rules.

Despite the blogs that you may read Geneva Roth Ventures is not a collections company. That is the lending department. The collections department is called Smith, Haynes, & Watson. Geneva lends illegally and SHW collects illegally. I used to work for them so trust me I know. SHW not only collects for Geneva but for several lending companies. Geneva lends under Utah law and in the contract it states that on your first due date they will take the balance in full unless you advise them that you want to pay the fee and extend your loan. However, that is not what they do. If you do not live in the state of Utah and you do not request that they pull the entire balance on your first due date. They will debit ONLY the fee and extend your loan an additional 2 weeks. With that being said, if you contact them and throw the contract their at them that they have breached there is a STRONG chance of getting out of the loan. Also, if you threaten either company with the BBB or your attorney general that will help you as well. These are people that this company are really scared of. Both companies are located at 6950 W. 56th St. Mission, KS. 66202. They are constantly getting sued for violations!!!!!!!!!
