I guess Gerald has done the reporting in your file inaccurately. Dispute the item and request for verification. They must have the legitimate details or the item needs to be removed from your file. Remember, collection entries hurt the credit scores severely. Do not allow the CA to keep inaccurate negative item in your file for long.

Check if the CA has put inquiries in your file. It must be removed if there is no genuine purpose for this inquiry.

linnie, Gerald has in fact hit your credit file with an inquiry. It is putting a negative impact in front of your future lenders. It should stay only if it has a legitimate purpose. Call them and verify this matter. (Why will they put an inquiry if they are not collecting for any company???)

The account in delinquent state is already reported negatively in the credit copy and is affecting the scores. Guess, a collection entry over it will mess up the scores. The time taken to repair the negative scar is a long and time consuming process

ok, I understand now. I pulled my very first credit report last year. I suppose I was scared up till then and I even had heart palpitations while I was reading it but it wasn't that bad.
I was diagnosed with a life threatening illness a few years ago and fell behind in everything. My boyfriend moved out two weeks prior to my surgery - RAT. :evil: I offically hit rock bottom. This is why I was sooo scared to read my report. I knew it would offically suck! So this is clean up from that era of my life. I am working hard on it. I am paying the accounts off that I can. It will just take time, I know that.
Gretchen, tell me this, I have two small accounts that have been closed "purchased by another lender". They are past the SOL however, I don't know who they were sold too. Never got anything in the mail or anything. How can you inquiry about that or should I even bother since it is past the SOL and paying them at this point will make little difference on my report.

linnie, inquire from the credit company whom they sold the account to. They may help you with this info because they are the ones who sold it out. But, most of the times, they don't want to pull out records buried inside.
The new creditor will appear in your credit file after they have reported with the bureaus. Sometimes, they hit quick enough, sometimes, it is lined up in a 'Q'. If they get in contact with you and have your accounts, they will enter the item in your file. From that point, you will have to handle the matter as required. Be aware of the statutes while talking with the company asking for a payment.

It is very unfair that we have to respond within 30 days, but they can take as much time as they want. If you hear nothing back from them, I would try and have it removed for failure to validate the debt.

I wish I had read about these guys along time ago! I posted about them about a month ago. I am now in the process of an Arbitration with them. They too checked my credit report back in Feb of this year. I had no idea then what they were doing. Well they sent me two lettes- both of which I responded too but they ignored and now I am waiting for someone I dont know to decide my fate. I did ask for a Dismissal but I dont know if I will get it. Im in KY- so I know GEMA doesnt have jurisdiction here. I belive the SOL is past the 5 yrs for Oral Agreements in KY, but Im not sure. Can anyone give me any advice as to anything more I can do? Ive printed off things about them that document their evilness, should I send them to the Arbitration Case Coordinator? I think she'd at least see who Im dealing with and may rule in my favor. I underestimated them. I believed they'd go away, I did everyhting right, cease comm. letter etc, but here I am not able to sleep because of them. Any advice would be great. Thanks.

If you have paid nothing towards the accounts in the last 5 years, the debt is out of the SOL period. Under these circumstances, the arbitration cannot put you in any legal troubles. The company can file a case against you but you can escape them legally if the statutes have expired. Confirm the date of last payment and show your file papers accordingly.

Well- I havent paid on it since- I am guessing here but I know it was in the year of 2000, maybe 2001, but I doubt it since I wasnt able to pay on it for very long. I did get a paper yesterday from GEMA telling me they have asked for an Indefinite Stay they have filed with the arbitration forum. I was told by some one else that that was good news, in that perhaps they may have shelved the whole thing. I did send them letters(few weeks ago) telling them I wouldnt be bullied and in short would not deal with them, could that have really scared them off??? I guess I'll have to wait and see. Not sure how I can get papers proving the last date of payment- do you think Gateway would be kind enough to send me such a paper???

I got a nasty phone call from a guy from Gerald E Moore. He told me if I didnt come up with 2700 dollars by next thursday he was sending a sheriff to my house, and I will go to court! Is this possible? I hastily gave him my debit card info, and now I regret it. Will I really get the sheriff?

What debt are they trying to collect on? This is becoming a very common threat by collection agencies. Have they validated the debt? You need to contact your bank immediately and have a stop put on the debit. If they haven't validated, you don't know that they legally have the account.

Representatives from the Law Office of Gerald E. Moore have been calling my home AND work for several months now. Is Mr. Moore's "firm" allowed to call me at work to collect a debt? I think not. I have found some disturbing information regarding Mr. Moore's practices on several websites. I even question whether or not he is permitted to practice "law" in the State of New York where I live. Mr. Moore personnally left a message on my cell phone threatening to take me to court and to have my wages garnished. What can be done to stop this perpetrator?

those people have been harrassing me since october. at the beginning i was afraid and payed a sum of money using a bank card. since then i started thinking and changed all of my accounts, but they are still calling. i received a call the other night with a person named james nixion when i told him he was getting nothing else from me (no information what so ever) i said i could pay with a money order he told me they don't take payments and they don't take money orders and started yelling at me and hung up.5 min. later ms.carter called questioning me and telling me it was my debt and i need to pay by western union until my debt is payed i said okay under destress. after i collected my thoughts i did some research on these people. and i am going to send them a letter of validation and after that a cease of communication letter. is that what i need to do? please give me some advice on what to do.

This company scared me half to death two years ago. At the time, I was ignorant about debt collection practices. A few days before Christmas I was driving along and received a message on my cell phone to call a number as soon as possible. I pulled over into a mini market parking lot and called the number thinking it was some sort of emergency. The man who answered stated an account from Capital One in the amount of around $1000 was placed in his office and I needed to pay it within 24 hours or I would be reported to the county sheriff and possibly arrested. In a panic, I told him I would have to call him back. I knew I had an old disputed account with Capital one, but I had not heard anything about it. I did not have that much money in my bank account. so I called them back later that afternoon and said I could pay them half now and half when I got paid again in two weeks. They said that was not acceptable and I need to do what I had to to get the money. The man said all of the paperwork was in place to proceed with my arrest warrant and the only way to stop it was to pay it. I had no idea what to do and I was so afraid to ask anyone for a loan. I ended up borrowing against my 401K. I told GM that I would send them the money once the wire transfer from my 401K went through. It did in a day and I paid it off. I figured they would send me something in the mail stating the account was satisfied, but I never received anything. When I researched them on the internet and found out how they violated the fdcpa, I sent them a certified letter outlining their violations. I then contacted the Attorney General who recommended I seek legal action. I filed a complaint through the Legal Aid Society and also contacted Capital One about the situation. I have to admit Capital One was incredibly helpful. About a month later, I received a cashier's check for a full refund from GM with a letter of apology and that the account had been called back by Capital One. I paid Capital One in three payments without a problem.
BUT...I wish I knew then, what I know now.

I have had 2 conversations with a debt collector from this office over the past few days. He is trying to collect an old debt of my husbands from 1998! Told me he wanted to give him the chance the pay it before they garnished his wages. Then he named off my husbands old employer and I said "Oh yeah" :roll: I asked him to mail me an invoice for the bill, he wanted to fax it to me, I told him I did not have a fax machine, he told me to drive to Kinko's and pay them $1.75 to pick it up. He was VERY UGLY. I've already had this removed from my husbands credit report... because it is NINE YEARS OLD! :shock:
The idiot I dealt with is someone called Donald S.... I never could make out the last name. He didn't want to send a letter because he KNEW I'd send him a cease and desist letter. Maybe we should all send them one and then when they call us again we can sue their sorry arses.
This guy I dealt with was so illegal in his tactics that I will use a tape recorder next time. NINE YEARS? Talk about desperation!
