2nd Mortgage/Banking Dilemma

We live in a very small town and bank with a local bank that only has branches in our county. We currently have our checking and 2nd mortgage with this bank. We got the 2nd mortgage 3 years ago and just refinanced it about a month ago when it came due.
The problem we are having is that our loan officer/account rep is relentless. Since we changed our checking account to them approx. 8 months ago, we have probably had a total of 10 overdrafts, which I realize is alot, but a flurry of them was from one debit that was processed even though we had stopped it. Friday, my paycheck came in and we were to have a large ACH credit from a customer (we have a small business). In addition, I made a pretty good sized deposit yesterday. This morning at 8:31, my phone rang and it was the loan officer (they open at 8:30), telling me our account was overdrawn, and that they were sending back a check, which happened to by my house payment. He repeated the fact that it was my house payment (for our first mortgage) several times and then asked if we had ever had a check returned to them before? I really didn't feel this was his business, but with this guy it does not seem to matter. I tried to explain about the ACH credit, but he would not listen. In addition, we just made a payment Friday and he started asking me when we would make the next payment (we are not behind). I told him a date and he kept saying well the bank examiners want us to document anytime someone says they will make a payment, so are your sure? Every time we speak with him about anything, even during our recent refinance of our loan, every time I asked a question, I was told that the bank examiners make them do things a certain way. For some reason, I feel that this guy is intentionally watching every move we make and is trying to be a jerk.
Several times over the past few months, this same guy has called me to inquire when our payment would be in, even when it was not late, and every time, he says you know you and your husband make too much money to owe this much, do you have a budgeting problem, maybe I need to speak with both of you, etc. Every time I speak with him, he says maybe you and your husband need to come in and we can work on your finances, like it is a threat almost.
I am forty something and am tired of being treated like a child by this idiot! We have been struggling somewhat, but are making some progress and trying to stay on track. This guy calling had me so upset I almost could not even work today as I was near tears all day.
There are rumors that this bank is in financial trouble and have begun trying to foreclose on some loans that are not delinquent-not sure of the truth of this, but a local business supposedly was served papers yesterday and was not a day late.
I guess I just need a little advice on if this guy is overstepping by continually asking what our personal situation is? I called another mortgage company today and was told we could not refinance only the 2nd, that we would have to re-do the entire mortgage.
Any advice is greatly appreciated!
