Help with payday loan nightmare?

I am in a bad situatin in Oklahoma with 3 payday loans, 1 for 300, 500 and 250. Was taking them out repeatedly to pay each other and now am in acceleration on mortgage. I have direct deposit and have no money each paycheck with the loans and fees and my house is the first priority. The lenders will not allow stopping payments.

Is this something that I could be prosecuted for for fraud or what would happen?

The only way out so I could keep my house would be to cancel direct deposit and let the loans bounce electronically, pay mortgage and then try paying them payments.

I have not done this but don't know what else and if the consequences would be just as a debt, possible garnishment or much harsh legal actions. Would I be considered a criminal


Pay your mortgage. They are going to threaten you with criminal prosecution/fraud. This is a lie and only a false threat, sounds scary and real but it is a lie, you will not be arrested. I would close the account and open a new one, and you need to notify them you have revoked their right to debit your account and they have to follow that revokation. What companies are you dealing with. PM me and I will give you some info.

I'm with all the rest - take care of your mortgage. Think of it this way:

You total for PDL is $1050. I get the feeling your house is worth much more than that. :) If I recall my small claims court knowledge, IF there was a chance they sued for the money, they can only get 3 times what you owe. $3150 is STILL less than the value of your house.

Here's the key, like Steelers said, they are going to threaten. But they use that as a tactic to get money out of you.

I agree with the rest...pay your mortgage! No sense in being broke and out in the street!

You may want to consider closing your bank account and opening another for your direct deposit. That way the PDL folks can't get at your money and you can still meet your household expenses!

I have been in the situation that you are describing.I had 4 payday loans. My husband had lost his job and I was the only one working,but we werent making it. What happened with us was we had rent to pay or we were going to be kicked out. Our banking account became so over drawn that the bank closed it. The payday loans couldnt withdraw any money. We got our bank account to a positive balance and just closed it out. We set another one and didnt tell the payday loans. It took them about a year before they started calling looking for there money. Most of the agents were very nice. They asked me why we stoped paying after telling them our situation they set up easy payment arangments for us.
Make sure you have your bank account statements showing what you have already paid. They will try to get you to pay more. Also be very firm with them the amount your able to pay weekly or bi weekly. They may try to say that they cant accept that payment. They can and they will if they want to get there money back.
Im not saying this is a gurantee. But they wont go out and sue you. That costs them to much money.

Don't feel bad. I am in the exact same predicament. Friday is the last day I will have my paycheck direct deposited. I have already contacted my human resources dept to stop my direct deposit after Friday. I will close my bank account on Friday and I can't pay the pdl's anything until I get my mortgage current. I feel so stupid but this site is a godsend because I now know I am not alone. I intend to arm myself with information so that the pdl's no longer have control of my money.
