Hello, Im Joey and I have a question on a loan that I got in 1999. After 8 years of no contact The loan company is sending me a letter that I missed the last payment of my loan. Since then I have filed Chapter 13 but didnt list this loan. To my understanding the loan was payed off. Can this loan company take action after 8 years?

Hi, what kind of loan is this? There is a SOL in every state for written contracts. The company loses all grounds to take legal actions after the debt is past the SOL. Know the date of the last payment and confirm the SOL expiry. It should also not be reported in your credit report now because it's already post the seven years reporting time period.

In the event the SOL has not run out, I'd contact your BK attorney. I know that you can reopen a BK to add a creditor not originally included in a Ch. 7; I'm pretty sure there are provisions that allow the same for a Ch. 13, too.
