OK I don't know if this is legal or not but here's what I'm going through right now with my account. As I posted before I became overdrawn in my account at the begining of the month. Now they are tacking on $5 charges everyday and I mean everyday for being overdrawn. My husband just called and they told him he was not able to close the account out pay off what was owed and then reopen another one. The biggest thing is they told him that he absolutly could not close the account out untill we paid off all of what we owe. How can they get away with this we have no money to pay our light bill let alone $405 (now not what was overdrawn) bank account bill. We would have it next month but now that they are charging five dollars a day I don't know if we will even have it then. Does anyone know how I can go about shutting this acount out without it getting up to around $2000 owed and then going to a collection. Yes this is the ammount the lady told him on the phone that it had to get up to before they closed it out and sent it to collection. Any advice would be nice ty.


Have you asked them if they could freeze the account? I've heard of some banks doing this..That's ridiculous to tack on all of those fees, how are you ever going to be able to pay it if the balance keeps climbing?

Maybe you could go into the bank and sit down and talk with the branch manager? It never hurts to try.

We just called the 1 800 number so I think we are going to go talk to someone at the bank since they never traded hands and the people there can look up and see that in a year we had only had 2 overdrafts including this one. The first one was for a goof up that was under a buck. Hubby said we'll go in on Monday and see if they can't close it out there and do it that way because we really want a bank account since he is getting his first early retirement check on Oct. 11th.

I messed up I had a $98 in it and wrote a $42 check to walmart for a battery my van was down for 2 months because of battery being completely gone. Then I wrote a $32 check for groceries, and paid $100 on light bill expecting to have it in there before it went through. We do not have overdraft protection, and so I figured if the light bill money did not come in so I could get it deposited ontime then they would just reject it but they didn't. Then I had a few more for gas and other nesecities for like $5 and $10 I added it all up as they were going through keeping a close eye on everything and as it was going through saw that only the $42 check and the $100 for the lights would not be covered they paid the $100 first even though the others were pending and made out before that one. Thus making the others come back bad also well they paid all of them even though we rejected the overdraft protection when opening the account. So know we owe what they paid out plus the $29 overdraft charges which added up to $356 total (29 bux 7 times adds up big time). Apparantly they applied the $98 we had in there to these charges which seems to be the only thing they did that was good. Now with these $5 charges we are owing $400+. So just one more question with no overdraft protection was it legal to pay the charges without asking us first?

I don't know about the legalities,but my bank pays for the od and then charges you an od fee. This was before they had od protection. Sometimes they will pay,others,they will not and send the check back. Since you said this had not happened much before,that's probably why they paid. If they hadn't,you probably would have had to pay a fee for od plus having to pick your check up and pay them too. I'm like Fins, go in person and talk to an officer of the bank. I did this with my son when he got real stupid and had a zillion checks od. They closed his account,and let him pay this off,and after that was paid,he talked to them and they let him open up another one. Good Luck...Karen

Talk to the bank about waiving off some of the charges. It is not impossible.

The banking laws in each state differ. Your state Dept of Finance will be able to answer this for you.
