I have a car loan with a credit union & it has always been current, but my credit card with them is severly past due, they gave both loans to a lawyer to collect the debt, even though the car loan was current & now refuse to discuss account with me, they even added a lawyer fee to the car loan & stopped pulling the car payment out of my account with them, I get bills & emails saying I AM past due on car loan, yet the $ is in my account with them where it has always been taken out - can they forward a current loan to a collection agency/lawyer? any help is greatly appreciated - I AM in FLorida & the credit union Alliant is in Chicago, Il


I am wondering something along those lines. I had a chapter 7 BK which was discharged on 2/10/2009. I reaff'd the car loan and also have a 5k visa card which is 9mos past due which i assume they are also cross collateralize-ing with it. I am wondering if i can do a debt setlement on the visa loan, or never pay the visa loan in hopes they pass to a debt collector and settle for much less...
