I need landlord help ASAP!

I am so mad and need some help guys:

Okay, so we were set to renew our lease on September 30, 2009, but we weren't sure if we were going to stay in our current apartment.

We have only lived here since last September and in that time, we have had numerous maintenance issues, problematic neighbors and the property manager is very rude to anyone who files a complaint with her. The assistant manager is fine though and very helpful when the property manager allows her to be helpful.

Anyway, we got notice that it was time for our lease to be up soon but I wasn't happy with their treatment of us thus far and I posted a review of the complex on an apartment rental website. I was truthful and concise in everything I wrote including how it took maintenance 5 separate times over the course of 3 months to get a leak fixed from my upstairs bathroom. This leak ruined my grandmother's hutch, blew out our television set and caused the flooring in the upstairs bathroom to cave in around the toilet and the ceiling below to fall out. They even sent out a "plumber" to look at the problem and he didn't even fix it right. Each time I had to call the office and make a complaint, the property manager was rude or abrasive.

Secondly I added that our neighbors to the right of us are constantly throwing trash over our privacy fence, parking in our assigned space, and the wife throws dirty buckets of cleaning chemicals out the front door of the townhome! One night I parked in the first "guest" spot in our row of parking and she threw the chemicals on my car when I refused to move it! It wasn't even her assigned space! I complained about this as well to the property manager and once again she was rude to me. I called the courtesy officer one time on the neighbors and he never showed up!

Lastly I remarked that as someone who works in the criminal justice field, that there were released criminals (including s*x offenders (S/O's)) living in the apartment complex. This is a HUGE NO NO as per the lease agreement that everyone has to sign. I added that I didn't feel safe letting my son go out in the back and play and that there are NO lights at all up around the complex.

So now I am at work this morning and I get a call from the property manager. She is screaming at me that she is calling her lawyer to "rectify this situation" and that she doesn't appreciate me lying about her in my review. She goes on to demand that I tell her the names of the s*x offenders living in the complex to which I reply "Check out the S/O registry website - that's where I got my information from." When she isn't satisfied with that, she says she wants to know the names of the other released individuals living in the complex. I tried to explain to her that although I didn't work anymore with these particular individuals that I had been seeing around the complex lately, I was still bound by confidentiality laws per our state.

She went on to tell me that I was slandering her name by saying she allowed S/O's and criminals to live in the area (I never wrote that she allowed them to be there) and that I was now going to "have my ass sued off." She also went on to say that there had only been 1 S/O living in the complex and she made him leave. But then when my husband spoke to her today at 2pm, she actually called HER boss, read him my review, and said that they had 2 S/O's that had listed addresses in our complex on their registries, but never really lived there. My husband tried to explain to her that even if they hadn't stepped foot on the grounds, addresses from within the complex still showed up and the general public would still believed they lived there. She then chased my hubby outside running her mouth saying that she never told her boss anything about any released individuals living there and my husband was right there the entire time she was on the phone with her boss!!!!!

So I ask you good people, can this woman sue me for slander? I was only speaking the truth when I wrote my review and as I tried to explain to her, I am a consumer and I have a right to my opinion.

What gets me is that before she hung up on me, she told me not to bother with renewing our lease and that "You're in big trouble if you don't remove your review!" When I refused, she then threatened to call my boss at my brand new job and tell them that I was a liar. I did remove the review though after a little thought, because I cannot lose this job and I wasn't sure if she was crazy enough to follow thru.

I guess it's a good thing our phone lines are recorded at work :)

So should I worry, or just let it go? I don't want to be like that woman on Twitter!


Of course she could sue you for libel (libel is written, slander is spoken). You can sue anybody for anything if you want. I would be very surprised if she actually followed thru. Also, she would have to prove that your claims were lies.

This whole Twitter thing is completely insane. Their are millions of websites that offer reviews of apartments, landlords, tvs and anything else you can name.

Just ignore it and get the hell out of there. Why would you consider staying at a place as bad as you say?

In my professional capacity, I've probably been threatened with a lawsuit over a thousand times. I always respond "...if I'm violating any laws, then it is your duty as an American to sue me." Not once have I ever actually been sued. My point being, people throw around that threat all the time, but never actually do it.

She couldn't use the same attorney they use to evict people, because it will take a special attorney to sue for libel. And so she'll have to front $1K or so as a retainer. Chances are that she doesn't have any authority to enter the company into that sort of lawsuit.

I would put the post back up, and put it on as many sites as you can. Further, I would write a letter to the editor of all your local newspapers and see if they'll put it in the paper. If you can document your claims, go ahead and let her file suit - she'll lose. (Remember, the burden of proof is on her to prove that you lied, it's not on you to prove the truth). Then turn around and counter-sue the company for your court costs and attorney fees; you could also probably seek damages for them refusing to renew your lease solely based on your valid complaints.

good advice DebtCruncher and everyone else, thank you for listening.

I am just so fed up because in all of this, we have NEVER been late on rent once, we have always paid to fix minor problems like a broken door knob or broken ceiling fan blade. We keep the townhome spotless (well, that's just my craziness) and this is what we get.......now I have to find another place to live and I hate moving!

Freedom of speech. I had the same situation. Sounds like our old landlord. I wrote a nasty letter to the corporate office about my situation which was like the person above. I don't know how some of these people get these jobs

Excellent advice from everyone. I would also pull out a copy of your lease and see if there is ANYTHING there about freedom of speech issues--and chances are there are not. In that case, make her prove how you violated your lease by posting not so positive reviews about her. And since they are the truth, this witch doesn't have a leg to stand on!
