Ocwen Foreclosure/Loan Mod

I don't even know where to start this has been going on so long... I'll try to cram everything in.

Back in December my husband had his hours cut back from 45 a week to 20 a week. We were struggling and called Ocwen our mortgage company to see what we could do to prevent any problems.

The gentlemen I spoke with (foreign, they all are), told me that we needed to be 2 months delinquent before anything could be done. Well, it wasn't hard to fall behind considering the loss in income. In February I called back. I was told that we had to apply for President Obama's foreclosure assistance plan. I had to fax in paystubs, copy of most recent taxes (2007 because we hadn't filed 2008 yet), bank statements, and a hardship letter.

I faxed in everything the same day. I was told 10 business days and we would have a response. So 10 business days go by and I call in. I'm told wait 10 more business days. Well, 10 more go by and I call in again. It's now the beginning of April.

I was told that they didn't have all the paperwork. They asked for my taxes. I told them they were sent in. Then they tell me they need 2008 taxes. Luckily I had just filed so I run to Staples and fax them copies of our 2008 returns. They say call back in 10 business days.

I call back in 10 business days and I'm told to call back in a week. I call back in a week and they say our application for President Obama's plan was denied because we don't make enough (uhm, isn't that the whole problem to begin with?!?). They tell me that they can do an in-house loan modification. I was told I had to put down a deposit of $1700 and then we could resume our regular monthly payment plus an additional amount to cover the months past due. I tell them fine, give them all of our financial info (again) and told they need 5-10 days to process the application.

I call back in 5 days later and told we were denied. We need to make a deposit of $4700. That's a pretty big freaking jump from $1700. But my husband's mother is willing to lend us the money, so I say okay. They say it will have to be processed and again ask me to wait 5-10 business days.

Now it's the beginning of May. I get a sheriff at my door handing us foreclosure papers. The entire time I was dealing with Ocwen they continuously assured me that as long as I was in the loan mod process no foreclosure action would be taken. So I'm shaking and really upset once the officer leaves after embarrassing us in front of our neighbors. (He talked LOUD about foreclosure).

I call Ocwen and basically ask them WTF? The letter said I had 20 days to respond to the complaint. The gentlemen I talked to at Ocwen told me not to respond because my loan mod was approved and I would get the paperwork shortly.

So, like an idiot, I don't respond. I wait a week, and still no loan mod paperwork. I call back in and I'm told that the loan mod couldn't go through because they were running my application a 2nd time for Obama's plan. They think they missed something. They still say don't worry about responding. And like the trusting idiot that I am, I don't respond.

Last week I get an e-mail from Ocwen saying they need ALL of April and May's pay stubs (because they've taken so long that two months went by!), they need proof of my husbands monthly trust fund check, and they need a utility bill for proof of residence.

I immediately gather everything and fax it in. I call Ocwen and repeatedly get an automated message that my application is under review.

Today I get home and check my mail. I have a letter from Ocwen's attorney that states the following:

"You are in default because you have failed to enter a written appearance personally or by attorney and file in writing with the court your defenses or objections to the claims set forth against you. Unless you act within ten (10) days from the date of this notice, a Judgment may be entered against you without a hearing and you may lose your property or other important rights."

So I IMMEDIATELY call Ocwen. Now, I can't even get to an operator. I keep getting transferred to "Rajid's" voicemail since he isn't in.

At this point I don't even have a clue what to do. I wasn't aware they could legally have a judgment entered against us without a hearing!

Now I can't get ahold of Ocwen and I'm confused and scared we are going to lose our home. All because they've jerked us back and forth for almost 5 months.


Make sure you understand the process of loan modification before you call your lender, remember thy are not your friends. Get informed first and use a third party that understands the process.

Okay, good news. I managed to get my loan mod. What I found out is that you REALLY have to stay on top of Ocwen. If they say call back in 5 days, call back in 3.

Also, if they are really taking a long time and being generally unhelpful, I found that the quickest way to get a response is to complain to the consumer ombudsman. There is a link on the Ocwen customers website to e-mail the ombudsman. USE IT!

Every time I was lied to about when my mod would be finished I complained. Every time they asked me for documents I already sent, I complained. Each time within 5 days I had an AMERICAN call me back. So at least I could understand what he was saying. He was a very nice guy who told me exactly what I needed to say and/or do to get things done.

In July I sent in my deposit and got started on my loan mod. I had a 2 month probation period. I had to pay August and September on time. I did that. And now my loan is considered current and my new interest rate is 4.707%.

I got a letter in the mail yesterday from the attorney's that were suing on behalf of Ocwen, letting me know that the judgment was dismissed and I no longer have to worry about foreclosure.

So, it can be done, just keep after them! :D

I too have been dealing with Ocwen since 2010.  They are very difficult to deal with.  They gave me a signed "Executed Modification Agreement" and kept telling me to make the new payments, that my loan was modified.  Then they later said that my modification is rescinded and i owed over $20,000.00. They forced me to file bankruptcy.  I have now contacted a loan mod attorney who has filed a complaint with the US Treasury.  Don't back down and I agree, keep on top of them.   They should be held accountable for what they are doing.  How can you mess with people's lives...

I have also been trying to get a loan modification I explained to Ocwen why I fell behind. That I had recently went through a divorce and my father who was helping had past away a couple of months ago :( I am really trying hard to get the mod done but Ocwen takes to long and is true they keep saying call back in 5 days, check with us in a week OMG!!! really!!!
