Not sure about your question. The creditor can always sue you over the debts if you have defaulted and a lien can be put against your assets, including house and bank accounts. In some states wages can be garnished too. But the creditor must win a judgment against you before imposing lien.
You might get sued if the settlement argument doesn't reach to an agreement.

Well it depends on several factors. If they pull your credit bureau, and see that you're paying your mortgage and it is current, then that will lead them to believe you have the means to pay but just don't want to.
They would probably rather settle than file suit, but it also depends what % you're trying to settle for as to whether they accept. Another factor is balance -- most likely a balance under $5k will not be sent for suit, but rather sold to a JDB. Although some JDBs are aggressive and might file suit after they buy your debt.
