Thanks to everyone who responded so positively to my last post and was so helpful. Worls Wide Cash now obviously failed in their effort to garnish my wages because they are till calling me for payment, plus I have not been notified by my employer that they will allow the garnishment. I also have signed up with a debt consolidation company to pay off my other debts, however they do not deal with PDLs. That brings me to one of my two questions-I was speaking with a co worker who was caught up in a mess with 7 PDLs before they became illegal in the state of Georgia. She told me that since these are internet companies and don't have my signature on anything, I may actually be owed a refund for all the extension fees I've paid. Each loan was $200 and I acquired two in November and one in December. I paid these fees biweekly and if what my co worker said is true, I paid off the loan amount in three weeks! Can anyone confirm that this is true?

Secondly, I need to know if it possible for me to write letters to all my creditors telling them I fully intend to pay my debts, but I wish to no longer be contacted? My debt management company will not contact the creditors until I have made my first payment, which will be at least a month from now because I can't afford the payment right now. I was recently scammed out of $800. In the meantime, these people are driving me crazy and I am scared to answer my own phone for fear that it is a creditor. They call me at work, which is exteremely embarrassing and they call my cell phone. I know they'd be calling my home phone, too if I had one.

Hi Phatbaby,
First of all..as far as getting a refund, if you have paid 100% of the principle and maximum interest allowed by your state's law, then you very well might qualify for a refund. Pollyandsay wrote a terrific letter that helped me and many other forum members..She's got a template letter on her blog, all you need to do is cut and paste your personal info and your state's laws pertaining to payday loans.

As far as writing a letter to all your creditors asking not to be contacted..This is called a "cease and desist letter", and yes you can write one. I had 6 payday loans last winter, and when I first defaulted I sent a cease and desist, along with a letter suggesting reasonable payment arrangements. All in all, my experience wasn't too horrific..Everyone I dealt with agreed to my arrangements, and I didn't have too many phone calls at home, and absolutely none at work. As long as you keep your end of the bargain, things will be easier.
I'm assuming that you're going through T&C? As soon as they get things rolling, things will be easier for you as well. Good luck, and let us know how it's going.

Hi finsfan13,

You response was pure sunshine!!!! It's not so much the fact that I owe these people that bother me. It's how they harrass me. How do I figure out if I have paid the principle and the interest? I've been paying extension fees of $89 and $79 twice every other week since November and December up until April and my loans were only $200 each. I did see Polly's letter and I fully intend to use it as soon as I get my ducks in a row.

In addition to the payday lenders, I now have two signature loan companies after me. As I mentioned, I was scammed out of $800 by an "advance fee" internet loan company. My signature loans were due at the time I was supposed to receive this other loan inthe amount of $9000.00. I intended to use this amount to pay off all my debt. So I wrote checks for my signature loans and never received the $9000.00. My checks bounced and these people are furious. I'm behind on everything now. Do you think I can use the cease and desist letter to work things out with them until I can get back on my feet and make my first payment with the debt managment company? Speaking of which, who is T&C? I've seen posts that have mentioned them, but I don't know who they are. I'm delaing with Advance debt management. My mom recommended them to me before I found this site and I actually was going to consolidate my debt with them before now and had to drop out because I couldn't afford to make the first payment (just like now.) except now I am working overtime just so I can have extra funds to start the program.

T&C is a consolidation company that deals with payday loans among other things..It sounds like they are very similar to Advance debt management.

I have to say, it's awesome to see someone like you here, someone who is taking the bull by the horns. It sounds to me like you know what's going on, and you're really getting your stuff together. Congratulations on that, you should be proud of yourself..Because of your attitude you're going to be just fine, trust me.

As far as figuring out what you've paid on the pdls...Get all your numbers together, and figure out what you've paid total on each payday loan. Find out your state's interest cap..What state are you in? I can definitely help you with that if you need help..Just pm me. Any amount over the original loan amount and the interest allowed is the refund you can ask. For some people it's a couple hundred, for some it's $50. Or you may only be able to get your loan marked paid in full. But still...It's one more thing you don't have to worry about.

I'm really sorry you got taken by the loan company. That's a tough lesson to learn. I don't know what companies you are behind on and want to use the cease and desist with...I know it won't work for utilities or mortgage or car payments

If I thought I still owed the PDLs, I would go with T&C so they could consolidate those payments as well, but I feel they owe me.

I have to admit...I love this site! I truly feel like i am not fighting this battle alone. Thank you for your encouragement, finsfan13! I am really trying to get out of this mess and look forward to the day when I can be like you and so many others on this site-offering support and knowledge from experience.

I am going to pull all my bank statements and get those numbers together, then I will PM you because I do need help. I'm in the state of Georgia and I haven't reviewed the laws yet-I just know PDLs are illegal here.

I am dead set on catching the individual(s) who scammed me. They've also scammed others. I have contacted every consumer organization I know of and I am going to my local police department to file a report and hopefully get some help with contacting Canadian law enforcement (the supposed loan company is in Canada.) So if you know of anybody who has been scammed, I can definitely help there. I don't have a mortgage and my car note is up to date, so I don't have to worry about that. I'm about to get the ball rolling. I will PM yiu as soon as I get those figures together.

OMG, Canada consumer, you are a lifesaver! I have so much info on this comapny and no one seems to be in ahurry to help me catch these thieves. The name of the company is United Capital Services (ucenterprises.com) You can read the full story on what happened to me and a few others at ripoffreport.com. There's a website called whois.com that allows one to type in the name of a website and it gives all the details of the IP address from which the site was started. I have all the false loan documents and everything that pertains to this crime.
