Hello, Iam going to court tommorow for a Bank of America card that is suing me. My company that I have been working with has totaly dropped the ball on this one. If I get a judgement agaisnt me If I can pay the entire amount wihtin ~30 days can the judgement be dropped. I have heard about a "grace" period? I live in California. Thanks

okay---from 'MY' experience...which might be totally different from you since I live in Tennessee. But I had a case go to court a few months ago. They dropped the paperwork off to me, and court was set up for 30 days from that day. I was to call the lawyer on the paper work (who was representing original creditor- SamsCLub). Lawyer gave me up until a week before the court date to have it paid in full and case would be dropped and no judgement on my report. I never heard anything about having 30 days afterwards as a grace period to pay it off and have it dropped. But maybe cali is different. This is just my experience. Shirley

Jenny,

It depends upon the judgment creditor and court you know. Court will judge ultimately whether you are eligible to receive the benefits of grace period or not. Grace period is a specific time that the judgment debtor is offered, within which enforcement of court order is not activated and debtor gets some time to pay the amount.

If you feel that a grace period would be of any help, ask your lawyer to get it passed. Please keep us updated if you find any more info.
