Hello all. As you know, Oxford has our dell financial accounts. I recently joined a debt consolidation group--freedom point--and included all of the dell account to oxford on the program. I have heard nothing back on whether they are accepting me on the program or not.
I did however receive two letters today---both the same but different account numbers...offering me a half off settlement. Impossible for me at this point right now. But this doesn't bother me, because I get settlement offers all the time, its other things in the letter that bothered me.

First off at the top of the letter where it says RE: it says,
RE: DELL FINANCIAL SERVICES for employer:********
(it has my husbands employer listed)

then it goes on to say that their client authorized them to accept the indicated as full settlement if it is received 14 days from the date of this letter---dated May 18. okay--blah blah blah

Then it goes on to another paragraph saying:
"this may be your last change to liquidate the debt before our client considers other collection alternatives. we may recommend that our client commence a lawsuit in order to protect their financial interests"
_____________________________

So, this is the usual standard stuff right? I shouldn't be alarmed by this, right?
But I am disturbed about them having my husbands employeer at the very top of this page in their 'regards' section. dell financial services for employer: ******** (my husbands work)

is this a scare tactic letting us know they know where my husband works?????

I just checked with my consolidation group to see if oxford has cashed the checks yet, that were sent on each account. according to freedom point, if they cash the checks, its saying that we have an agreement.
I'm a little concerned. shirley

Shirley,

It seems that this company has complete information about your accounts. Since they have it in their records, it has been put in the letter also. But, you must make sure that they are not trying to leak out your personal information to others. If it is done, it will go against the privacy policy of the company.

Request your consolidation company to update you with the latest status of your account. If the check has been cashed by the company, sounds well!

yeah, but say they do have complete info, these are the clowns that refused over and over again to validate when I sent so many letters certified return receipts. also, they are the ones that call my house three and four times a day every day since me telling them to STOP calling. seems they do what they want to do. thanks for responding John. I haven't heard back from freedom point yet. just was curious about oxford getting my payment and still sending me a letter telling me that they could still suggest that I get sued. and then I take my husbands employeers name in the header as a threat too. was wondering if this means that they're going to take my money every month and stab me in the back.

They could have gotten your husbands employment info from your Credit Report.
Let em' sue (though something tell me they won't). You have the paper trail 5 miles long to show you have been trying to address this issue and you are in a consolidation program, further evidence you are trying to deal with the matter. You even said yourself Dell \didn't know what was happening with these accounts./ I would suggest calling that lady at DFS back and asking her what going on, and see if she can do you any good.

I think Oxford has become a loose cannon, make sure your documentation is in order, as you may also have a fdcpa violation case on your hands.

Thanks Clay!! always look forward to hearing your wisdom on things! I heard back from freedom point and Oxford has cashed the checks that were sent to them..also Freedom told them that upon cashing the checks, meant we have an agreement. maybe for my paper trail, I should try and get a copy of that proposal sent by freedom point, in case I should need it later? i don't know if they will do that or not, but it could only help my cause. thanks again! shirley

Shirley,

I would send a copy of the letter to your debt counselor as well as get a proposal letter from them. It's better to be safe than sorry. Also, if you sent a validation requestion with a cease and desist letter to Oxford via certified mail with return receipt requested, then they are violating the fdcpa laws. They must validate the debt before they can continue trying to collect on the account in question. If they are trying to collect without validating the debt, then they have broken the law. It's plain and simple.
