Trying to help my mom on debt validation of hospital bills

I am trying to help my mom find out some information. She works long hours and not able to research things. On October 4, 2005 she received a letter from Roth & Rathburn Attorneys at Law out of New York City and she can't find any information on them anywhere. The letter stated she either pay her hospital bill in full or court action will be taken. She has been making payments to the hospital and the hospital has been cashing the checks. She sent them a debt validation letter to them and all they sent in return was a copy of the bill. That isn't considered a validation of debt, am I right? Enclosed with the letter, she said she received notice of litigation, this was received by mail. If they are going to litigate, doesn't it have to go to court first?

Do you know if the said debt is with the original creditors or sold to third party collection agency? If it is sold to the law firm, then the hospital is not supposed to collect payments from mother. I assume that this law firm is one of the internal collection agency engaged in the process.

A copy of the bill cannot be termed as a proof for debt validation. There is no question of litigation also as your mother had been regularly paying towards the bills.

Does your mother have the return receipt of the debt validation letter sent? Ask your mother to dispute this bill sent as debt validation and send to the law firm. Make sure that it is done within 30 days from the receipt of this bill. Send this also through certified mail with return receipt requested.

Also, contact the hospital authorities and know the latest standing of this account. Pull your latest credit report from the three bureaus and compare this account. Keep the basis strong and frame her proper approach. Do let me know your move.

After the debt validation is sent, you have 30 days to dispute it. So, ask your mother to send the letter of dispute within this period.

If the debt is not disputed within 30 days from your receiving their letter, this will be considered as valid and legal actions will be enforced.
