I recieved a call from National credit Adjusters in Kansas. The first thing they told me was that they bought my account from a creditor and now they own the account and i need to pay or they will sue me and put a lien on my house and car and garnish my paycheck. I told them that i will send you payments using money order or through western union, they refused and they demanded my bank acount information and they will withdraw the money. I refused to give them my bank account information and they hung up the phone and they said the will see me in court, I haven't heard from them for about ten days. I dont know what is going to happen. I just send them a validation letter to verify the amount I owe because it wasn't accurate. any body know anything about this agency. your advice is greatly appreciated.

Keep your cool. Nothing will happen unless the company proves their authorization to collect for this debt. Anything said orally doesn't prove everything. They must validate the debt in writing that they received from the original creditor. They are trying to scare you with hot air. Post your complaints to the AG's office and the FTC. Have you sent the letter by certified mail? You need to have some proof of your actions.

Thanks for your reply. I did send the Validation letter certified!, can a debt collector who purchased my acount sue and garnish my paycheck.

Unfortunately yes. For doing this, they will need to file a case in the court and prove that you are avoiding payments on it. First, they first need to confirm that your account is with them. Having said that, the debt should be validated in writing and you need to know all info related with this account. By chance, do you have idea which account are they collecting for? You can call the original creditor and get more info about this account. They can check their system on your request.

I Called the original creditor and the told me that my account was sold to an agency called PTP, so I called PTP and they told me my account was sold to NCA the same ones that called me two weeks ago.

It looks like your account passed from one had to other. Make sure that the company gives you enough info to prove about their authorization. What state are you in? Maybe, you can check the SOL based on the last payment you did on this account. No legal actions will happen after the debt gets past the statutes.

The last time I made Payment was 7 months ago. I live in Michigan. Can I go back to the original creditor and work with them to make the payments.

Unfortunately, you lost the legal hold with the latest payment. The debt comes within the statutes. The only way you can avoid legal actions is to make payment arrangements after they have shown it to you in writing. You cannot make arrangements with the original creditor because the account is not with them. They sold it to another company who now become the current creditor. You need to confirm the real company having your file. Check your latest credit copy if you can find some new info in it

You have done the write thing by sending a dv letter via certified mail. I hope that you included return receipt so you have proof that you signed for it. I am dealing with this as well after a failed relationship with a debt settlement company. I had one call me in November from an attorney's office on a debt that was less than $500. He made all kinds of threats but I am able to record phone calls in my state without their knowledge. You may want to see if Michigan allows this as well. Keep everything documented. You have the right to dispute the amount since you do not think it's correct. They must show you how they arrived at that amount. I have not heard of this particular CA but you can check them out with the Better Business Bureau as well as the AG's office in their home state.

Thank you for your advice, I called the AG office and they told me not to give them my bank account info. Also I checked with BBB in their state, they had 26 complaints against them for illegal tactics one them was making unauthorized transaction and charges.

I recently pulled my credit reports and i have a few collections listed. I am quite sure that these debts are valid. Should i still send these collection agencies a cert. letter requesting validation?
