Westbury Ventures threatening criminal prosecuiton

I got a call today from Westbury Ventures, it went something like this:

"Joanna, you can keep your little money. I have mailed letters to your home and you refuse to acknowledge them. So you can keep your money and I will have our atty's file criminal check fraud charges against you in your state of KY"

I have been getting TONS of emails from this jerk. Everytime I get one I say "send the DV". He refuses to send me debt validation. The only thing I receive is that same form letter with MoneyGram info on it over and over. He claims that I borrowed money from "him", but I know the original creditor is Arrowhead. Doesn't he have to send me the debt validation? I tried to send a certified letter to them, but it came back as no such address. Can he file criminal check fraud against me, even though it's prohibited in KY?


I had two loans with the Loan Shop totaling $500. In all I paid $1200 on those loans. Westbury Ventures started illegally debiting my checking account when I revoked the debits. Since none of the debits went through, I got this email today:

"When a person intentionally neglects to pay back money loaned to them on good faith, it is an unacceptable act of deception. Because our Collections Department has not been able to obtain the slightest amount of cooperation from you to resolve this very serious matter, we have changed the status of your account to ???????Refusal to Pay/Intentional Neglect.???????

Through your actions (stopped payments, declined payments, accounts closed, breaking payment agreements, or ignoring calls) and lack of cooperation, it is evident that you have no intention of paying this account willingly and further actions must be taken. This change in status escalates the matter and seriously limits your ability to pay this loan back on your own terms.

However, there still remains a short window of time in which you may be able to reach a settlement and a payment agreement that will be comfortable for you. Please contact us immediately to discuss this. The consequences for the actions that you have taken were clearly explained in your signed loan contract, as were the means at our disposal to collect what????????s owed from reluctant debtors.

Note that making a payment in Jan. of at least $250 will again upgrade the status of your loan. Additionally, providing a payment plan will effectively ???????Freeze??????? your loan, stop further fees from accruing, and keep your credit safe."

I guess threats for criminal prosecution will come next.

I agree!

I was not going to respond to it but, I just could not resist. Here is most of what I wrote:

"Dear Mr. Smith:

Since you are into definitions, try this one predatory lending "the practice of a lender deceptively convincing borrowers to agree to unfair and abusive loan terms, or systematically violating those terms in ways that make it difficult for the borrower to defend against." The is no such thing as "good faith" with a predatory lender. You try to ruin me financially and call that "good faith."

I took two loans totaling $500. So far I paid $1200.00. Do the math. I have paid back the loans almost 3 times and you call this intentional neglect. As you on medication or drugs?

When I took these loans, I did not know my rights. You are not a licensed lender and legally all I owed based on the laws in my state is $630. I have paid almost twice that. The only settlement I will accept is Paid IN FULL.

I will no longer allow your company to victimize me."

I just received this email from them today:

SUBJ: Statement of Debt

Your payday loan(s) is seriously delinquent. If you have not already made specific arrangements to clear your name by satisfying your debt, You need to call now. I can and will make every effort to work with you to get your good name off of the Collection Department floor. Take the initiative, pick up the phone ???????? Go after this debt, -- Instead of it coming after you ???????? Stop being afraid to answer your phone.
Remember when you were proud of paying your bills instead of ducking and dodging them. Clear your Good Name, and Conscious, Call me

This is the same company that I $450 on a $300 loan and I asked for a refund and they told me that I wasn't owed a refund but I owed them more money.

Seems like they have been busy today. I got an email from The Loan Shop:

I guess she wants to tell me I'm not entitled. I responded back reminding her that she is only to contact me by mail or email and anything she has to say can be done in those formats. I haven't heard back from her.
