xpress cash call me threatening legal action for a loan i never paid in march 2005 said it is check fraud when i never even signed any paper work!!


So I have nothing to worry about?? I have been sick worrying that I am going to go to jail!!! First they wanted me to pay back 360.00 then it went down to 200.00. I talked to 2 different people in 1 day. I don't even remember the site or anything I got the loan from. Should I just pay the 200.00 or just let them do what they have to do??? i just don't want to go to jail over 200.00

Taking money from a company, legal in your state or not, and not paying it back is stealing.

If you haven't paying anyhting on it at all I suggest you being sending in what you can as soon as you can and continue to do so when you can until the loan is paid or settled in full.

You can check the licensing info of XpressCash with the Department of Finance/Attorney General of your state. The payday loan company should not have lent you the money if they are not licensed in your state. But if you have a loan from them, you will pay the principle amount along with permissible interest rates and finance charges. The interest cap in PA is 23%

its best if you just talk with them and tell them that you are willing to pay back the loan and request a written statement of how much you owe them.
An operator telling you how much you owe a company is not what you should get. Get a written statement, like a recept.

Then begin paying it off. Or pay it off in full, what ever is the case.

Ahhhh poo on them! They have threatened me to no end with all sorts of tactics. Dare them to come get you and you'll have them thrown in jail without the key for their illegal practices.
I'd say get the deal in writing first, either by email,fax, or snail mail and sent the $200. Since they want to negotiate, there's some wiggle room to either get a payment arrangement or reduce the amount you owe if you've made some payments already.
Don't let them scare you, their just a voice on the phone.

I have not paid anything back because since then i filed banruptcy and thought that xpress cash in included in that which it wasn't. i am willing to pay it back but not when they call me at work every 10 min and have 5 diffrent people doing the calling. first they accused the loan to be deposited into a bank account that i never even had the time they called my bank and all called the manager there a liar that that was the bank account the money was put in and well fought with them for a few hours and my boss until he told them to never call my work again so they finally called me at home (which they never once did before nor sent any letters) and said they are sorry that they had the wrong bank information, and get this they the guy was in the legal departmant at xpress cash and didn't even get the information correct.

You're not stupid, you're just learning! A cease and desist letter simply states that they not call you at home or at work. When I sent mine I said that I would not talk about payday loans over the phone and would not accept any calls from them, but I would be happy to respond to any emails or snail mails. There's no specific way it has to be written, but you might want to search the forums for cease and desist letter samples. It makes things a whole lot easier. Oh...And when you send them, make sure you send them by certified mail.

Also, I want to add that I did not mean any disrespect with that "having fun with you" comment. That is part of Brad's job....to harrass, make threats, and makes you nervous.

ALso, it is illegal for a company to make threats and not follow through on them. (from what I understand). If the company is not licensed in your state, then they can not take you to court.

Also, if Brad threatens to report you to the local news, tell him to go right ahead!

First of all, don't worry about Xpress Cash, their threats are empty, as are all threats made by someone who comes after you under a small, unsecured loan. They can't do anything to you other than frazzle your nerves, unless you cooperate with them. So don't give them the satisfaction. Don't talk to them, don't respond to them no matter what. Close your bank account, and just write them off. They will do the same with you once they realize that you are not going to pay back their money. Once you start talking to them and agreeing with them and making deals with them you are setting yourself up for headaches. Xpress Cash is a very shady company, they have numerous complaints that have been filed against them with the MO BBB. I know of more than a few people who are bringing legal action against them. Again, they can only do stuff to you if you let them, these people are lowlife slimeballs, don't give them the chance. And while you are at it, why not take the opportunity to kick these people in the balls??

Don't worry about brad, he couldn't do anything to you even if he wanted to. Tell him to read the part of the agreement that says all disputes will be handled by an arbitrator. He can't read, so that does him no good. I was amazed at how literally stupid the people who work at the PDL companies are.. I mean really? Do they pull these people off the street? Crack houses? Jail? Fast food joints? Skid Row? The drunk tank? The Ozarks? Ok, maybe that is going too far, but it is fairly safe to say that most of these retards are people you wouldn't want in your house, they would probably stael something. Thats the kind of people you are dealing with here.. Don't give them the satisfaction.. Also, these places have an INSANE turnover rate, can you guess why? Must be a great job when you have to try to collect on people using dishonest tactics, etc. Not to mention, unless you get someone who buys into your crapola, you are nothing but a harmless paper tiger, LOL.

I know I'm responding to this late, but Xpress Cash did the exact same thing to me - from depositing money in the wrong account to threatening to have me arrested at work and all that crap. I hung up on them twice and everytime they call, i hang up. I'm not going to talk to them, and I suggest you don't either. Nobody is going to jail over a payday loan. If they did, I would have been locked up a long time ago being that I have fallen into their trap numerous times in the past! Pay the $200 and be done with it!

Oh my gosh, I posted a thread about this jerk who has started harrassing me...sending me e-mails and calling me at work, threatening me. He's also calling my co-workers and even spoke to the CEO.
Can I ask, whatever happened with this situation? Obviously, Brad is still working there because he is now making my life hell.

Here is my story. I had a payday loan with express cash back in Oct 2003, in Dec of ???????05 the took over $400 out, I had no idea who PD6/Whistler was, then I found out. On June 26, 2006 I received this email

I was mad! They did not contact 2 years later to tell me they were going to take money out! I????????ve had payday loans before, and I didn????????t want to get into with them, they said I didn????????t have to pay anymore. Well ON July 3, 24 & 31, I got withdrawals from my account with the name exprescash/loan. I thought who is that. Want I want to know if anyone has had exprescash/loan on there bank statement and could you tell me if it????????s the PD6/whistler, express cash place. I????????ve called, emailed and faxed and nobody will return my calls or emails. I want to make sure this the same company who told me I was done with the account so I can kiss there ass and get my money back. They used a different name my bank statement. I just want to make sure its them.

I recieved a email today from Westbury Ventures threatening to take legal action against me and my roommate this woman told me that I was going to be prosecuted and also my roommate if we didn't send $700.00 immediately,I told her what are you talking about? She replied your that we had taken out a payday loan for $250.00 with a typed signature,I said I don't have this kind of money and then get this she then said i will settle for $390.00 and eat the rest of the $700.00,Also we don't even have achecking account that she claimed we committed we did check fraud and we have a savings account not a checking at our credit union.What should we do,she stated that if the$390.00 was not money gram to her by thursday she would take legal steps against us.

Someone else also mentioned the situation I am in.

Recently the amount of $24.19 was taken out of my account. I applied for a coupel differenlt payday loans at teh time and got one which I immidately paid off next pay check.

Somehow in the process of simply applying, one of the companies I apprently had a history with (as in I had taken loan through them back in Aug 2003) and they used the information I provided for a new loan to start to take out money.

I am almost sure they were included in my bankruptcy hearing in 2004 but of course I have to double check.

Is it legal for them to use the information I gave to apply for a new loan to automatically do this without contacting me?

Does any one have any other advice about what I can do whether or not I find out I did, or did not include them in my bankruptcy?

If it was included in your bankruptcy they are NOT permitted to do that. I would find out if it was included (hopefully it was) and then dispute it, because with a bankruptcy the debt no longer exists. And you have your court documents to prove it. I believe the companie can get into big trouble for this.

I received a direct deposit into my checking account the other day and I had no idea who from until the next day when it said Whistler Holding Xpress Cash. When I googled it, this page was the first hit. Can anyone tell me who the heck this company is. I didn't agree to a payday loan with this company!! Thank you.
