I have paid a debt and now it is being collected again by another company. I find the calls very abusive. If I need legal help to resolve this can I collect legal fees from the collection company if they are wrong and the debt has been paid?

Hi, welcome to the forums!

Sorry to hear of your recent troubles with the collection company. Do you mind sharing a little bit more about the details. What collection company is this with? Who was the original creditor? And how are they being abusive.

I'm hoping you first told them that you already paid on this debt. They would have given you the oppurtunity to provide proof of documents, and closed out the account pending their review.

You could also send something in writing to the new collection company asking them to provide proof they're legally allowed to collect on this. If provide proof, then you might want to start barking at the other collection company you paid. That's a double-wammy!

Please review section 806 of the FTC rules/laws. If they have voilated any of your rights, you may want to seek legal action.

Hope this helps. Please let us know on the outcome of this.

Regards
Mike
