About to do battle with CashCall-Western Sky

I have closed my checking account and opened a new one. Tomorrow I will be sending a letter to Cash Call.

Loan taken out in May 2012 for $2600. Received $2525 - Western Sky took $75 before sending. I have paid $1065.63 to date, but my principal balance as of today is $2593.

I live in NC. I have searched thru forums for a good letter that deals with tribal, usury, etc. but can't seem to find what I need.

Anyone have suggestion what to send or where to look?

I am going through the exact same thing. I took out the loan with Western Sky/Cash call about the same time as you and paid them about the same amount. I closed my account also and do not plan on giving them my new one! I am kind of worried that I did not even pay the principal on the loan yet and I will not have the money to even do that for a while. I did not file any complaints. I have sent them emails but they keep insisting that a call them. It is not going to happen. There is no law that I know of that says you have to speak on the phone. I do plan on making payments to at least cover the principal borrowed but they are going to have to wait. Hope they don't file a lawsuit on me. Let me know how you make out with them

I am going to pay them principal only. May take me a few months but it will keep them at bay.

After going round and round with them via email and getting calls every day since the ACH payment on 10/1 was cancelled, I filed a complaint with NC Attorney General today.

Hopefully, that will get their attention and I can pay off the remaining principal and put this matter to bed.

I too am just starting the battle here... Can you share what you included in you complaint with the AG? Curious on what all I should include. Thanks for any insight you can offer.

I have gotten nothing back from WS/CC other than the email that reminds me what I signed and also go that in the mail? When I responded I got an email asking me how I got their special email and then I just told them that I was told to copy that person and that I was trying to make arrangements to pay my principle balance and then nothing for a week now.. we'll see..

  • NC Atty General sent notice to CashCall that they are in violation of NC Consumer Finance Act, and N. C. Gen. Stat. $ 53-164 and 166. In addition, because of the serious legal issues raised, NC Atty General has requested that they cease and desist from further collection activity on this account.
  • NC Banking Commission has put them on similar notice. It appears that CashCall may be licensed as a mortgage company, but not for consumer loans.

    I believe these two letters will let me proceed with getting them off my credit report finally. Keep fingers crossed.
