Now want to remind everyone that on 10/2/2012 received this email from them:
"Thank you for your correspondence. I have received your email request to cancel the auto withdrawal on your loan. Your request has been processed effective today. Please keep in mind that your due date is the 1st of every month. Your account has been placed in a cease and desist status. All communications from CashCall going forward will be communicated in writing through mail or email only. I have also sent a Permissible letter to your email and home address this should answer all of your concerns. Have a great day.

Customer Concerns Representative "

Now maybe I am confused on what cease and desist status means? Don't think so but maybe. Are they supposed to be still trying to collect?

I have sent several emails about an arrangement for a payment plan to make good on the principle that I still owe - I show that on the original amount of $2600 - $75.00 fee - payments made already of $1126.53 = Principle owed is $1398.47... .. Not one response to that of any kind.

Today in the mail - I get a letter dated 11/2/2012 - Giving me basically a loan modification. That if I agree to pay $294.46 by the 16th of Nov they will defer 2 payments to the end of my loan and I will not owe another payment until Jan. They want me to sent the signed modification back to the Loss Mitigation Team by the the 16th of Nov.. And even if I do accept they remind me that collection activity will not cease during this offer!!? But, from above isn't my loan already in a cease and desist status, from their own email to me on the 2nd of Oct?

I does go to state things like "your CashCall loan", I did not take our a loan with CashCall? "under the terms of your CashCall Promissary Note- The copy of the loan agreement they themselves sent me says Western Sky?

Now the Agreement and acknowledgement for Modification is signed by Steve Klopstock - Director of Collection. The letter itself is from Gaile Kefallinos.

They do threaten me with reporting negatively to the credit reporting agencies. Also, with taking action to determine my ability to pay my obligation under the note. Like ordering my credit history from any of the credit reporting agencies. - Can you tell me how I can maybe stop this?
Also, that they will be contacting my employer to verify status and compensation - I will be taking care of this on Monday .. I don't think my employer even verifies wages at all, but I will still be addressing on Monday morning.

Complete this is like 4 pages of garbage - any input on what to do next, I have been sending them a weekly email to agree to pay the remaining principle - but now they are just being stupid - they are willing to defer 2 payment to the end so instead of being done in June of 2016 - now they think I am going to agree to pay them until August of 2016 = $294.46 x 45 months = $13,250.07 + $1126.53 already paid = for total of $14,376.60 for a $2600 loan..
I show that on the orginal amount of $2600 - $75.00 fee - payments made already = Principle owed is $1398.47...

Please,give me your input....


It seems to me they see trying to make you reafirm your loan with Western Sky with the original payments and probably interest. I would not sign it at all. To make the payments, I would either use a pre-paid debit card or send them money orders. Do this on your schedule, not there's.

CashCall knows the only option they have in getting paid more then the principal from you is either to trick you like with this document or with scare tactics.

Sorry about my first post. I did it last night about 11:00 pm my time and was punch drunk from being tired.

The worst I have had is nothing. They may try to turn you into collections but if they do use the C&D letter SOAPLADY has on this site. They may send statements via mail etc and start calling you but I think that is as far as they will go. This is my personal experience with them.

Thanks for the input, not really worried at all just letting all know what trash they are sending - Thought that is was funny that they kept referencing a loan that I have with them, that isn't with them but with WS- and that they themselves in an email on the 2nd, state that my account status is in Cease and Desist.. But, yet they are still trying to collect.. so, a violation, No? They really are showing how stupid they are..

I did make sure that they can not call me... I updated my numbers with them prior to sending the letters, to old numbers.

@waffles - the reason I was asking about the C&D letter - if I need to even waste my time with sending one, is the fact that they originally stated in the email from them to me on the 2nd of Oct that my account was placed in C&D status - so if that is true why are they attempting to call me and collect? Will sending them a letter do any thing different now?

They have sent me 3 of those modification letters trying to trick me into affirming that I have a loan with CC and allowing them to pull my credit report and contact my employer, etc. I have returned them all with the words REJECTED - no account with CC written in bold sharpie across every page. They still keep sending them....

I'm gonna try to get the turn of events out to all: I know it is long, but trust me interesting to those of you who are getting calls from them....

I got home yesterday and seen that they had called yet again, so I shot off this email to them, my base email with this addition: "I have sent several emails to your company trying to get this matter resolved, maybe we can get this resolved this time? Also, I feel this is a good time to again remind you that any and all contact is to be made through email or U.S. postal mail only, I prohibit you or your affiliates from contacting me via telephone at my home, my place of employment, or my cell phone. I also prohibit you from calling my references listed on my loan. I know that you know this since you, yourselves have stated that my account is in a cease and desist status since this email from you on 10/2/2012 - "Dear Customer, Thank you for your correspondence. I have received your email request to cancel the auto withdrawal on your loan. Your request has been processed effective today. Please keep in mind that your due date is the 1st of every month. Your account has been placed in a cease and desist status. All communications from CashCall going forward will be communicated in writing through mail or email only. Thank you, Nikki Carmody, Customer Concerns Representative, Customer Service: Phone 877-525-2274" So there for I am not sure why I am still receiving phone calls as of yesterday 12/5/2012 at 6:20 pm from CashCall - from phone number 877-525-2274, also received calls on 11/12, 11/14, and11/20 . Do I need to report these calls to the FTC, for violation of a cease and desist?"

With in moments I received this back: from their Dispute Resolution Department - now the only two things I did different from the last 15 emails to them was mention the FTC and copied WS themselves in this email.."According to our records, CashCall has not made any calls to any of the telephone numbers we have on file for you since May 5, 2012. Additionally, CashCall updated your account on October 2, 2012 to ensure that all communication would be in writing only, per your written request to do so. Please confirm the telephone number(s) for you that were called so that we may investigate this matter further.
If you would like to discuss settlement arrangements for your account, you may call us at (714) 221-3300.
Sincerely, Dispute Resolution Department"

I sent them the number to see if they would then blast me with calls, "Dispute Resolution Department,

I have received calls on my house number xxx-xxx-xxxx like I stated on the following dates - 11/12 at 1:10 pm, 11/14 at 3:36 pm, 11/20 at 3:47 pm, and again yesterday 12/5 at 6:20 pm. Please, advise on this matter. I am willing to discuss settlement arrangements on my account again via email only, will not play this he said she said game. Send me your proposal to resolve this matter and we can go from there." which doesn't matter since they are blocked

And again in mere moments " Thank you for your quick reply. That is not a telephone number we have listed for your account. We will investigate the call times and dates you have listed and will respond to you shortly with our findings.
Sincerely, Dispute Resolution Department"

I guess we will see what happens next....
