I have too many payday loans and cant get out of the cylce, I was wonder if anyone knows if american web loan and 7day advances are legal payday lenders in the state of Ohio. I have more loans but most are I pay on them and some goes to interest and some to principal so I assume thay are legal? I couldn't find much on a search for Ohio laws . Can anyone help me
Thanks

one of the loans I am dealing with is American Web Loan and here is the reply I have gotten from them I have borrowed 600. and have paid back 1159. It doesn't seem as if they are gong to budge one bit

We did receive your letter requesting to revoke ACH authorization on your loan with us. You also made statements that we are not legal in your state, I do want to advise that is not an accurate statement, as a reminder, you did not get this loan in your state, you got it over the internet, and on our agreement we fully and clearly disclose that we are part of the Indian Nation, and that your state laws do not apply, here is a section of your agreement.

This loan is made and entered into with you by American Web Loan, Inc., an arm of the tribe, wholly-owned and operating under the authority and laws of the Otoe-Missouria Tribe of Indians. This Agreement is subject solely to the laws and jurisdiction of the Otoe-Missouria Tribe of Indians. By entering into this Agreement, you acknowledge and consent to be bound by all the terms in this Agreement; you consent to the exclusive subject matter and personal jurisdiction of the tribal courts for all disputes arising from this Agreement; and you understand and agree that state laws or regulations do not apply to this Agreement, the interpretation of this Agreement or the enforcement of this Agreement.

I am not able to provide you with the statement you request, as your loan is not paid in full. Since you have chosen to revoke authorization, we must come to an agreement on how you will repay your remaining balance, In order to resolve your dispute, I will offer as a one time courtesy to begin an extended payment plan. The EPP will allow you to take 60 days to pay the principal balance of your loan, with no further fees. We can divide your balance of $600 into 4 equal payments of $150 and begin to close out your loan. Time is of the essense in setting this agreement up, As if we do not have it in place by the close of business Friday, the next due date will begin to process. Please let me know how you would like to proceed as soon as possible.

Their usual response. They know that your state laws apply but they are just trying to confuse you. You do not live on their reservation and you are not a reservation member, thus you are not subject to their laws. The only laws that apply are they laws of your state...and you can tell them that.

Yes, you signed the papers BEFORE you found out that your state prohibits these types of loans.

The contract is void due to the fact that they are not licensed to lend in your state.

Regardless of what they try to convince you, they're full of it and they know it.

Your state's laws are what apply. Period.

Simply continue to reply with what you told them in the first place.

why are you running scared?you are owed a refund by this moronic tribal lender.as ohiogal, and soaplady stated the loan is illegal making any contract null and void.they can't do squat except email stupidity.keep resending your original email with a refind demand added if one isn't in there as again you are owed a refund by american web tards.
