suit filled against me from Michael Scott atty for Capital One

I found out that a suit against me was filled in Harris County on September 10, 2012.

I moved out of the County on June 29, 2012.

The only reason I was made aware of a suit against me was because my mail was forwarded. I received a letter the week of October 8, 2012 from a Houston Attorney wanting my business to represent me on my case.

I looked on-line and sure enough I saw the suit filled.

I also saw on the that a petition was filled on September 26, 2012 with a code reading : CV-CITATION 534-OUT OF COUNTY

What does thee CV-citation 534 mean? Do I need to file a petition also? Does it mean the case would be dismissed and the suit can be filled in the county I currently reside in?

Would this be a continuance of the originial suit or the plaintiff would have to start over? If he starts over with the suit, can I file for a VERIFICATION OF DEBT?


They have probably been made aware of the change of address/county thru mail forwarding...they pay for that service. They may just motion to move the judgment.

FYI...the attorney more than likely represents Capital One. A simple call to Cap One would verify it. Cap One rarely sells their accounts. You could also look online...if cap one is the plaintiff, they still own it. They can and will verify it easily.

If you are looking to settle this before a judgment, do so quickly.

There is no judgement only a suit filled.

I looked up my credit report and the account with Capital 1 says closed by credit grantor July 4, 2010.

I did notice some of the account I could not pay stated in the Credit Report as Sold.

Last payment I was able to make was on December 1, 2009.

Is there anything else I can do?

How can I settle with them? Will they refer me to Michael Scott?
