My question is are the following lenders illegal in the state of Virginia?:

Plain Green Loans, Cash Call, Great Plains Lending, Cash Net USA, Netcredit

Also I saw a template for an ACH withdrawal and can't seem to find it again. Can you point me in the right direction please.

I know for a fact that Plain Green and Great Plains are Tribal and illegal not matter were at. Not sure on all the others, As for Cash Call was the loan with them or Western Sky? If Western Sky, also illegal due to tribal.

Follow the link in my signature - how to deal with illegal lenders, by Ohiogal step for step and this will help! an example of the ACH revoke letter is there.

This link will help you with looking at payday loan laws by state. USA Payday Loan Laws by State But, remember that tribal lenders are illegal everywhere.

Someone should be able pipe in also and answer about, Cash Net USA & Netcredit! I am sure they are both also online illegal lenders but do not want to give you wrong info on them.

Let us know if you need any further assistance.

Cash Call is only servicing the loan - treat them like a illegal tribal lender - follow the instructions in the how to deal with an illegal lender in my signature by Ohiogal.

Make sure you have your bank account secure, closed or for deposit only prior to sending ACH revoke letters out. You will want to tell the bank you had fraud and that supply them with copies of your letters, Make sure you talk to someone at the bank that knows what they are doing - revoking ACH authorization is allowed under federal law- you are NOT asking to stop payment.

If have other questions feel free to ask.

For your information there are many illegal finance companies here online, a million perhaps, They would most promise you about how to get better repayment plan, and lowering your payment loans. But actually they don't. My personal belief is that payday loan sharks are the scum of the earth. Visit this website, I am pretty much sure that they can help you in all sorts of your situation. Good Luck!

ve followed through with all the steps that were given to me through the thread. I have now started to receive emails from Plain Green Loans. This is the email they sent:

Dear Shirley,

Your correspondence has been directed to me for review and I thank you for the opportunity to assist you at this time.

We understand that all situations are different and would like to offer you the opportunity to pay the remaining principal on your current loan in the amount of $1400.00. We are willing to settle your account for this amount, payable in ten (10) monthly installments in the amount of $140.00 each, payable beginning December 31, 2012 and monthly thereafter. Payments made on prior loans were made according to the contracted rate and will not be applied to your current loan.

To further clarity your questions regarding the legality of this loan, Plain Green is organized under the laws of the Chippewa-Cree Tribe of the Rocky Boy’s Indian Reservation of Montana (“Chippewa-Cree”). Plain Green is owned by the Chippewa-Cree, and operates exclusively on land owned by the Chippewa-Cree. As such, Plain Green stands as an “Arm of the Tribe,” in the view of the United States state and federal courts. Therefore, loans made by an arm of a sovereign Indian nation are not subject to state law. This is NOT a payday loan.

This letter is written to help you understand that Plain Green and its loan contracts are governed exclusively by the laws of the Chippewa-Cree.

Pursuant to your request, we have removed your contact numbers from our system and we will make no further ACH debits from your account.

Please reply if you would like to accept this settlement and set up payment arrangements.
