are you sure they can't put you in jail


We are not sure about your situation because you haven't told anything specifically about yourself.

However, it is true that the court won't send you to jail for not paying the debts. This is a civil case and it will be resolved in the court itself. The most that can happen will be a default judgment against you and wages being garnished. If you have any property, it will be revaluated for paying off your creditors. Some states have specific laws on writing bad checks. You will have to confirm the laws in your state.

A debt of itself is not a criminal offense. So no, you cannot go to jail simply for owing money.

However, if criminal acts were involved in obtaining the debt then charges can be filed. Some examples would be obtaining credit under false pretenses, using someone elses identity to obtain credit, fraud, forgery, etc. Those acts can lead to jail time.

Yeah I have ipdl people calling me daily saying they are sending me to jail and it hasn't happened yet. Look and see what the laws are in your state. All lenders must abide to the laws of the state you live in. I live in MI and they can't bring criminal charges against you. Read all the posts and you will see that this is just a scare atctic for them to get their money. Keep positive it does get better.
