Today I received a letter from these people and they want payment sent to them at Malcolm S Gerald and Associates 332 South Michigan Ave, Suite 600 Chicago, Il 60604, but they have an address in the upper left hand corner PO Box 1058 Oaks, PA 19456. Thats when the first red flag went up. Then I checked them out on the BBB site and they have a unsatisfactory record with the bureau. I am going to hit them with a debt validation letter.


bill collecting companys are all rude thats why you have to pay your bills on time but if you dont then they can be your best friends since they are the ones who can freeze your accnt from fees' or offer you a settlement as long as you work with them then they are good people i just recived a letter in the mail for my credit card called them and was able to freeze my accnt for 2 months and pay it off in full beofre i got hit with more fees. every comapany has a few bad employes so just call back and try agian this company helped me out alot.

My adult daughter just got a call from them asking for me, she tried to get info from them and they said they just needed to talk to me. They said they have another number for me and read off a number she'd never heard of, and she said, yeah try that number. Any place where I would have a debt has my contact information, but I haven't received any calls from their number. And I have had the same PO Box for over 20 years, and I have received nothing from this firm, so why are they trying to call my daughter if they are a handling their business in the manner in which they are supposed to? By the way, my daughter works for an auto loan collector, and is no idiot, she knows what they are and are not supposed to do. They should not be calling your references before trying to call you.

your compnay sucks...and you prey on people who don't even have business with you ...your company preys on people and harasses them even when you are told that you have the wrong people...if you continue to harass us we will sue your asses off.

i informed hsbc to close my account in 2007 and begin paying them off, well i paid all but $30 come to find out and was never contacted. I paid the amount the rep. stated was do to satisfy the account. Well a year later 2008, I am contacted by a collection agency representing hsbc. They inform me that i owe a total of $1200 for both of my cards. Which i refused to pay the full balance do to the error on hsbc's behalf. I settled for around $835. A year later in 2009, I get a call from the good ole Malcolm S. Gerald and explain that i have already settled the account and paid off the balance. They stated that the account had not been satisfied and scared me into paying them. So i settled with Malcolm S. Gerald for a balance of $400 so settel both accounts. Well guys, here we are a year later in 2010 and the are pursuing me again and using a different collection agency RPM. I explained that i have paid the debt of twice and would not be paying again. I got my bank statements and researched. Well the first collection agency i settled with the deductions to my account showed to be HSBC. With the second our lovely Malcolm S. Gerald was shown perfectly on my bank statement. Well i sent a dispute letter to RPM with my statements and never heard anything...when i contacted them back i was told to call another agency ReSurgent. This woman told me to fax the information to her and i would hear from her in 3-5 days. Didn't hear anything back of course...so i call 3 wks later and they hadn't even reviewed my information. Didn't notate my account nothing! On top of all of this she was extremely rude. Well she tried to tell me that she didn't have all the info. so i asked what she needed. it was provided in the packet and i directed her to the correct page. Then she stated she didn't see where the payments were made. So i directed her to the correct page again. Then she put me on hold contacted M S Gerald and began to tell me I only satisfied $ 200 of the settlement amount. So yet again I had to direct her to the correct page were M S Gerald deducted $400 from my account to settle this debt... REALLY MALCOLM S GERALD on top of poor customer service, lack of correct information, harrassment you have to skim off the top of debts you collect from debtors. I mean there is really no other explaination for this. So guys what do i do at this point? Get legal assistance? How do i get my money back? Is it even possible?

You LIE. You called and gave out ALL my personal information to a stranger!!!! This is totally against the law. I will see you in court for this!!!! This cost me my job!!!!!!!!!!! I have no debt and you have attempted to ruin my credit and my credibility.

Same here, got a letter from Malcolm S Gerald and Associates,Inc with $1092 debt
the creditor is Publisher's guide

so what did you do then? and what's going on now??

Thank you comments were helpful. I received a call from this company today and I was shocked they would not state the purpose of their call. I engaged in a guessing game with them while they tried to figure out which person they had called. Spoke with two reps who were very rude. Called them back numerous times trying to resolve issue. Finally, reached a manager. I found out they were trying to collect on a debt from 13 yrs ago, 1997 that was reported fraudulent, closed and resolved with previous lenders. I am glad I ran across website and comments. They were helpful. I was told to send this company an email? Could not understand that part either.

I am glad I found this post. I asked these people to send me something in writing and to send statements showing my payments. They wouldn't do it. I let them draft my account against my gut feeling. They have taken about 4 pymts. After reading Dave Ramsey's Money Makeover workbook, I've decided to stop the payments. Ramsey advises not to give ANYONE access to your accounts especially without something in writing! Duh! I will not let anyone else pressure me into these kind of agreements.

Yeah I wouldn't pay these guys anything. The fact is they seem to be collecting debt for illegal scamming operations or something. Which I fell into myself, now they have sent me debt collection paper or whatever. Claiming i owe over $1,000 to a magazine company called 'Publishers Guide' that tried to scam me, and when I tried to stop my account, they claimed i didn't have one, since then they've sent me magazines, and will not stop.

I rec'd a letter yesterday from MSG (oh wow,just realized what those letters stand for...LOL). Anyway...it's for a dental debt that is about $300. They misbilled and charged for services not performed on my kids and I have been disputing it for 2 years. My first dispute went to GECC 2 days after I saw the first billing that went to the insurance company. They ignored it. Told me to try to fix it with the dentist first. Worked for almost 8 months trying to get credited for over $1100 that they charged for services not performed. Then they turned me over to Apex Financial. They called some 12 times a day on my cellphone (yes, I have copies of each bill showing their number on it every dang day for months). I finally just blocked them on my cellphone...the calls stopped. It's been very frustrating for me. I sent them a ceases and desist letter and they stopped sending everything...just passed it on to MSG. Started getting phone calls from MSG about 3 months ago only the caller stated on each voice mail, "The Law Offices of Malcolm S. Gerald & Associates". So I have that 5 times saved as voice mail. I got this letter yesterday. The amount has gone up $200, and I'm not paying it. My credit has already taken the hit for the "charged off" bad debt so I really could care less at this point. I willl send them a C&D letter today and file this away with the others. So if they want to sue me, they are welcome to do so. Funny thing is, I would have gladly paid that $300 or $400 (can't really remember now what it was) 2 years ago and if someone sent me a legit letter I would do so now. I don't play these games and I'm not going to start. Everyone needs to realize that these people have laws they have to follow. If they break them, and you can prove it, they have to PAY YOU. *smiles* I know this because I used those laws to my benefit. Take em to small claims court. If they don't show, you win. It's only like $25 to file. Take the time and get them off your back..but only if you truly do have the documentation...only if you really have done all that you say you have...only if they really are calling you before whatever time your state says is legal or after the latest time they can call. Do it right. Do it well. Or don't do it at all...pay the bill. *smiles*. Good luck to everyone!!!

They never sent the letter and I have been anxious about them taking money from my account. I wish I could have found this site before. WHat recourse do I have if any?

I have had a university of phoniex tuition that I needed to pay for and I just procrastinated for about two years to pay. I decided to go ahead and settle this debt because for 1 I needed my transcripts released and for two the rep there Mario was pleasant and answered every single question I had. This company also placed my mind at ease before agreeing to settlr because they emailed me the settlement offer and insisted if any doubts I can always cross reference their company with the client which was the university. For once Im glad I procrastinated this long because I saved money and it was reported paid in full even though I settled just took a fee months to update. Overall I looked over all the bad reviews you just neec to talk to the right people.

I have received numerous calls, most recently at 6:24 p.m. CST on Oct. 15, 2012, for Emily T. Smith on a number that I have owned for 7 years. After repeated requests to remove me from their list, they claim they do not have a list and request my number yet continue to call at inappropriate hours of the evening. Answering staff is rude and incredibly unprofessional and when I dial the given extension, a message says "now connecting you to (obvious indiscernible ???*jibberish)." I encourage others to witness firsthand this disgusting harassment by calling the number 1-800-265-3796 ext. 329. I can only ascertain the non-validity of this company based on the countless complaints during a simple Google search of this company. I have contacted my local Better Business Bureau to carry out any appropriate action necessary to cease these ridiculous calls. Mr. Gerald and his "associates" should be absolutely ashamed of their debt collection practices.???*
