Hello,

My name is Kim, I don't even know where to begin. I will start in the year 2001. My mother who was a transplant patient passed at age 59. I was the one who had to bury her pay funeral cost etc. My husband had just been laid off of his job of 7yrs as well. So needless to say the burial was a hardship but it was something that had to be done. Well 16 months later my grandmother passed and of course I had to do the same all over. We had no other family to turn to that could help as I help the Power of Attorney for my grandma. So did what I had to do. In any case I then found myself in debt and turned to the
PDL's online and local I managed ok for a while then ended up with a lien against my bank account for a car
loan I had gotten for my mother and ended up filing bankruptcy with an organization that was just as bad as the PDL companies, to make a long story short, my husband and I had no legal representation in court. The bankruptcy attorney came in told the judge that he had come staight from another case and did'nt have our paper work and that he would run to the office and get it and return. Well that was 9/03 and we are still waiting for his return. The judge did go on and in Dec. 03 we receive discharge papers. But to be honest we never received any councel at all so there were items left off as well.

To try and come to current times, I was laid off in 9/04 after 17yrs of service with the company I was with. I was out of work for approximately 9 mos because I had surgery that took a while to recover from. I started working this yr for a good company but in the mean time I resorted to the PDL sharks again. I had to feed my 2 kids and had/have every intention of paying but then I started getting hit with judgements from 2 previous loans I had that if given proper legal advise in the first place would have been on the bankruptcy. I also have quite a few medical bills one which is a Judgement as well. I am due to pay on 3 of the payday loans this week and I am broke as I get paid once a month and they know this. So I fear the return fee\'s and the next step. We also had a title loan in which the car used stalled on the highway and dissappeared and to this day we have not been able to track it. The van as it was stalled the week of Thanksgiving 05, we took out that loan in Aug 05 and paid it monthly out of fear because we couldnt find the vehicle till 6/06, we just couldnt afford to pay any more the loan was for $600 and we paid on average $180 or more depending on if we were late.

At this point I/we just need advise on how to get control again. HELP!

Kim, I am really sad hearing your situation. If possible, try to increase your monthly income. This is the first and foremost thing which needs utmost concentration. It's very necessary to increase the income so that you can make the monthly payments that have taken the legal shape and save some money for meeting other essential necessities. Things will really take an adverse shape if you default in paying off the debts on which judgment has been awarded. You should also seek some professional advice to get some control over your situation. Advice from a trained and experienced professional will be greatly helpful.

See if there's free legal aid in your area. They might be able to help with that judgement and stay any garnishments that may develop.
Also, as far as your payday loans, you may have to call them and tell them your situation to see if they'll accept some small monthly payments.
Increasing your monthly salary by way of a temporary extra job will definately help see the light at the end of the tunnel.

Thank you all, it just felt good to get it out. My next step is getting a part time job. I already work ungodly overtime but the draw back is I am salaried. I dont get paid a fortune I am not a boss of anything or even close but being salaried certainly has its drawbacks.

Being salaried means to be restricted to the 9 to 5 job. There is hardly anytime left for doing anything else. But since you really have positive thoughts of finding solutions to your problems, you will taste success sooner.
