My story on PDL
Date: Thu, 09/28/2006 - 14:24
First off, I will save you the backgorund story. I was horrible with managing money after leaving college and that is basically why I ended up in this mess.
I currently have 7 PDL. I live in NC. All are internet loans including ameriloan, Ambassador, Emerald, GSF, Magnum, 1 Click Cash, and Paycheck Today. I have paid more than the principal on all of them. I plan to close my account with Bank of America tomorrow. Any help or guidance would be greatly appreciated.
Thanks!!!

First off, you have done the right thing by paying off the principal amount to all the lenders. This is good. Payday loans are illegal in North Carolina. This means that the lenders violated the laws by lending in your state that does not allow payday loans. Call these companies one by one and demand a paid in full letter. Keep the contact info of the attorney general of your state with you. You might need it in case the lenders intimidate you in paying more.

Just wanted to post an update.....
I just this week started getting calls. GSF is offering to settle the loan for $200. The others just keep calling and calling. I don't answer the phone and just have them sent to voicemail at work.
I have sent them letters demanding paid in full status, but they do not respond. I plan on sending letters to all of them again today.
Is anyone else out there in NC or anywhere else that has been through the battle with any of these places before that could offer some guidance?

Also, when you e-mail/call these PDLs, make sure to let them know that you are involving the AG in this. They hate hearing that, and it seems to make them more willing to make a settlement with you.

OK...here is the latest. Everyone has pretty much left me alone at this poing except for GSFIL who continues to be a pain in the back side. I finally called them back today after they called my work ten times in three hoursand asked for my supervisor. Here is how the conversation went.....
We were calling about your over due loan. How would you like to fix this?
I am willing to make a payment of $50 this week, but that is all I can do
HOLD ON PLEASE
We cannot accept a payment that small. Can we just debit the full amount from your checking account?
-No, that account is closed so it will not do you much good.
HOLD ON
Can you send a money order for the full amount?
-Nope, only $50
HOLD PLEASE
I will have to let you talk to my supervisor....
I understand you have a loan that you defaulted on.
-Yup.
Can you pay this from a checking or savings account?
-No, I don't have one.
Do you have a friends account you could use?
-No.
If you will open a new account and get me the information I will debit $200 from the account on your next payday (3 weeks away) and close the account.
-OK I can do that, but I would like that agreement in writing.
I will send you a receipt as soon as we receive payment
-No, I need something in writing before I am going to send you anything.
I will be turning you over to our legal department.
-OK, thank you!
These people are scum. If you default on a loan with them be prepared for a war. They will call you about 20 times a day at home and work. Has anyone dealt with them previously? I have paid these fools $800 on a $200 loan.

a word of caution - under no circumstances would I give them your new account info. I wouldn't trust them to close the account, even if you have it in writing. I would tell them you'll send them a money order or a certified check.

I am definitely not going to. I know that these people are one or the worse ones to deal with. After talking to them I trust them even less. I don't even think at this point I would send anything to them. I just got really frustrated when they called me at work bothering me and my co-workers today.

dbaker is right, no matter what they threaten never give out the new acct. info. I would stand firm and get just as harsh as they are getting with you. After all you have what they want, and if they want it, they have to go by your rules. Pardon me, but, screw their legal department, if they were any kind of legal dept. they would know that they are violating laws and in the wrong. So I would not give much weight to what they say or threaten.

Have you reported GSFIL to the Attorney General yet? I would definitely do this, if you haven't already. They are not allowed to be calling you at work and definitely not allowed to ask for your supervisor. This is between you and him. They're violating your privacy. Guys, what else can greenrhino do to keep them from calling at work?

I think alot has already been done. You can try sending a cease and desist letter. But because they are the original creditor they don't have to abide by it, but I guess it wouldn't hurt to try. File complaints with the FTC for violating privacy laws by divulging the nature of their calls to co-workers. They are just trying to humiliate you into paying them. Just hang up on them.

Okay, I would send them a certified letter with return receipt requested stating that you can no longer accept these types of phone calls at your place of employment. I would also fax it and e-mail it if you can. They don't need to be contacting you so much at work. You stated you paid what you owed in principal? Then you should be fine and starting slamming them with the complaints. Attorney general, BBB, Division of Financial Institutions. They will be more willing to mark you account paid in full then. Also, keep everything documented when dealing with any internet pdl. Welcome to the forums :-)

My letters will be going out today. So far (kepp your fingers crossed) I have received NO calls at all from these jokers. I did have a $200 loan with them, but I had paid almost $800 to them.
I know that I first came here just wanting to know what to expect so here is an update to help the rest of you. This week has been quiet I have had a total of only 2 calls including the above to my cell phone and no calls from anyone to work. WooHoo!!!!!
I will continue to post updates as time goes on to let you know how things are going. Thanks again for everyones help you guys are awesome.
The fact that you're not getting phone calls sounds promising.
The fact that you're not getting phone calls sounds promising. Once you send the letters out, they may agree to mark your account paid in full (two of my four did) or just stop contacting you altogether.
Definitely keep posting to let us know how it's going. We'd love to hear from you.
Another Update
Today I emailed ameriloan telling them basically that they were breaking the law in my state and that if my account was not marked paid in full in 5 business days I was turning them over to the BBB and my attorney.
About 2 hours later.....an email saying my account had been paid in full!!!! WOOOOHOOOOO!!!!!! That was too easy!!!

Great news, greenrhino! I know, I couldn't believe how easy it was, either. And, just for the record, regardless of what they state in their contract, they still have to go by the laws of the state that you reside in (just in case you come across this with one of your other loans).
Good job! Keep up the good work.

Maryland
I just used your link to find out that these loans are prohibited in Maryland as well. I just sent a letter to what i assume was customer service for the loan company expressing that we have only filed for extension once but they keep debiting our account. I am going to contact the AG right now for Maryland. They have taken almost 1200.00 for a 300.00 loan we extended once. Thank you so much. If there is any more information anyone can give me that would be great. I'm going tomorrow to close the bank account and reopen another one.

I have yet to have any response, besides the bank of course. What are you suggesting i register for? The debt consolidation or something like that? I've just been trying to find some info and assistance on how to handle this situation. But any help is appreciated

update
Well i sent an email last week to xpresscash.com using a reply to an email they had sent me. Thing is, 2 days later it came back to me as undeliverable unable to connect with their server. Bank states we can put stop payment on the debits but it will cost us 35.00 each time .. thats 70.00 a month. Only other thing i can figure is to close the account and reopen a new one. I think i'm going to have to go that route. i have never heard of a bank who would blatently allow charges to be made on your account when you say they are no longer given permission to do so. I would change banks but weve ben with them for years and are trying to obtain a consolidation loan so we can pay everything off and have only 1 bill every month taken right out of the account. It really is the only way for us to get above water. Pay everything off that is outstanding and just pay once a month.. wow that would be much nicer and easier than having to pick and choose who gets a few bucks here and there. Because of course they all want it all at once and are never willing to bend in any way. But anywho... back to xpresscash.com AKA as broadmore ventures, anyone have a working email addy for them?

Heather, what bank are you with? When you put a block on a company it should be good for 6 months and cost a fee, if you don't close the account then you would have to renew the block for another fee. Somebody with a valid e-mail will probably post it once they see your post requesting one. Have you tried faxing this letter to them? (XPRESS Cash dbas: PD6Ventures, DMS Marketing, Loan Shoppe, the list goes on and on)

Heather I was with Bank of America and was forced to just close my account. Since closing my account most of them have just stopped contacting me all together. As I noted previously I have had 2 of them mark my account paid in full.
The only one that continues to be a pain in my back side is GFSIL or Global Financial. Yes, they are just as crazy as you read in the other posts. Luckily when they call me at work I am able to take it another room and close the door. I have found that if you just actually talk to them when they call and tell them, "No, I'm not sending you any money" they will stop for a few days.
I've started having fun with them to help me deal with the stress. I will say "Hey, you guys haven't called in a few days where have you been." The guy that called today actually laughed. I have noticed that if you insult their English then they will hang up on you also.

Heather, I also dealt with xpresscash, etc.,etc. After sending off my PDL letter to LTS Management Services, also affiliated with this company, I received an e-mail from a John Kimball, willing to bend over backwards to work with me. I would send him an e-mail, stating that you had an account with xpresscash, how much the principal was, how much you overpaid, and request a refund (mine was for $150). Good luck. Let us know how it turns out.

Well i found their "main" website and there is a contact us link there, via email. I sat and typed them out an email and when i hit submit.. you'll never guess what happened!!! I got an error message, so i contacted the web host. LOL they tried to tell me that it worked fine for them and sent me a screen shot showing nothing but the web page. So i did the same after hitting submit again. No further response from the web host as of yet. I am about to try again. I dont have access to a fax machine and well considering the financial strain it has put us under, my phone was at the bottom of the list of bills to be paid so i have no phone right now. I emailed the AG office for Maryland on friday and still no response from them, not even an automated to let me know that it was recieved. Maryland really is a horrid state to try and get any kind of legal help with. I'm a transplant here from Pa and the differance in peoples attitudes are amazing. Ohh well for those who need help might i suggest you go to family and friends rather than the PDL places?

Thanks, i have a friend who has a fax machine, i emailed it to her asking her to fax it off in the morning. I just like the faster responses via email. I'd love to do both. I couldnt find the actual address for the company either. I know i've seen it posted but cant for the life of me navigate myself around this board. Great. If you have no success with that, I did find a phone number, also, that Steelers1 had given me when I was dealing with them. It's 1-800-757-0122, X353. The collections supervisor is Brad Weathers.
faxed
Well my letter has been faxed for about 20 minutes now. So being the neurotic humanoid i am, i'll be checking my email every 5 minutes until i get a response. Lets all keep our fingers crossed here. My bank still will not agree to block these debits. I have informed them that this comany is making illegal withdraws from my caccount, have been told they are no longer authorized to do so and if the bank does not take the steps to protect me as a customer i will turn their corespondance with me over to the appropriate authorities as well. Lets see if that lights a fire under their rears.
Heather: I'm so sorry to hear that your bank is not cooperating

Now, all i have to do is get my hubby to stand firm on the refunded money. This is in his name so i've been doing all of this leg work and typing out the letters and calls and faxes and stuff. Hes very laid back and reserved so i'm going to have to write him a script LOL. I'm just tickled pink that this pay check we'll have 90.00 more than we have had since june. YAYYYYYY ME

I stumbled on a link having a calculator to tell how much intrest was charged on the pdl's i cant seem to find it again. I know it was well over 700% >shriek< if anyone has it could they post it again for me please? I'm having hubby call as soon as he gets home

I'm not sure where the calculator is, but I just wanted to tell you CONGRATULATIONS!!! That's great news! What a relief, isn't it?
response
YES it is.. it will be an even bigger relief once i get my money back!!! people dont realise how much further in debt these things will put you. We took out 2 at one time for a total of 500.00. We paid the 200.00 off right away and we extended this one once or so we thought. We're bad with keeping track of the bank statements and things but all of a sudden every single pay period we came up with sometimes 7 or 8 over draft fees. i mean at 35.00 a pop thats alot of money. I had the bank reverse quite a few of them but there are some that we still paid and i honestly >not looking for a scape goat< think its because of these deductions. I mean when you count on an extra 9000 to be there, you spend it yanno? I doubt they will do anything with overdraft fees but if i can get the 500 back over the 300 i'll be one happy camper. Thank you guys so much

Heather, you're welcome. You're right, people don't realize how much these loans cost you - and you think they're doing you a favor when they "allow" you to rollover a loan. Never again, though. I am really happy for you!

Well when my hubby got home he called miss shirley. She and her manager were very short with him and i got on the phone and of course they wouldnt speak to me. But i did manage to get the manager to tell me we were very lucky she marked the account as paid and that the 240.00 they were refunding us was more than generous. We took the offer and figured at a later date when other things werent going awry in our lives we'd address the remaining amount with the AG. they tried to tell me that when the loan was taken out, they were legal in maryland. Although i thought on the maryland site it showed them as illegal as of like 02 or something. I said well june of 06 is nowhere near before 02 Anywho.. we are getting 240 back because of course they are charging the 90.00 "processing fee" isnt it funny how the PF is the same ammount as the finance charge??
