What are the SOL in AZ?

I incured a debt to Discover Card and as I don\'t deny it, I do hope to take care of it when I go back to work, but the time being I can\'t afford it. My husband supports our children and I. MCM says I owe them over 5K on it. My origional debt with Discover was 1400. I haven\'t received a letter or phone call since 2001. They somehow got my new number and have started calling me. I find this odd because it just fell off of my Experian credit file and is falling off of my TransUnion in Feb of 07. What are my rights and how do I find out where they came up with the 4000 in fees or whatever. If I could come up with the funds to settle for about 1400 I would do it. SOmeone please tell me what to do. I would appreciate it! Thanks. Needing help, C in AZ


Oral contracts are within the SOL for 3 years and written contracts are for 6 years in AZ. Did you get the debt validated by MCM? State the federal laws about validating the debt and give you proper calculation of the interests and fees. Without this info, don't pay anything because the account might be disputed. Ask the following information from the collector when getting the debt validated. Read the FTC website for more information.

Welcome to the Community :D Be carefull about offering them a payment or agreeing to a settlement,until you get a debt validation from them. It probably is out of the SOL period,and some junk debt buyer bought it.You will receive info for your free credit counseling soon.Get your debt validated first!
