NES What a nightmare

So they have been calling and calling and each time I tell them that I have been paying for months and they still call. Then they choose a day and call and say that I can settle today for this amount of the credit card company is going to take me to court, that I would pay all the court costs plus the costs for the company who is suing me. They also tell me I don't have a leg to stand on in court cause I signed a contract saying that they Credit card co. can sue me and i will pay all the legal fees if this went to collections. My husband was out of work for a year so we got behind. I am a young newlywed trying to get out of this hole that my husband and I dug ourselves into when we first started living together. Has anyone been sued by the credit company and what was the outcome? Did you get taken to court or did it just sort of disappear?
I don't know what else to do other than pay them $200 a month like I have been doing. You cannot get blood from a rock. HELP!!!


If they sue you it will go to court and a judgement will be entered. Then you will either get your wages garnished, or in some states they can order the sale of property to pay for the debt. Your best bet would be to contact the company and see if you can set up some sort of payment arrangement so the it doesn't get too bad. The more you communicate your situation with the creditors, the better they feel about waiting for you to pay. If you just ignore them they assume you are refusing to pay and will take some action.

Get the settlement in writing. I hope you are able to afford the deal and pay them off one time.

Since your account is current, there is no way your credit card company can prove in the court that you are avoiding the payments. The latest statement will prove out the facts. You also need to present your point to the judge. Show papers of your income and expenses to the judge so that he knows well how much you are able to afford. The judge will rule out in your favor because of your positive attempts.

Most credit companies often say that they will take you to the court, but they do it very rarely. Try to settle the matter outside the court before they finally make up their mind of filing papers with the court. Remember, your payment efforts and your account in current status is your strongest defense. Keep it that way only.
