I need to know my rights. I received a call at 4:50pm on Feb. 1st, 2007 saying Henry Jay was an investigator and was filing check fraud charges against me first thing in the morning if I didn't pay $575 ASAP for a payday loan. I asked for the information and why I wasn't contacted earlier and he had no response. He just kept telling me that I would have my license showing a warrant and I needed to take care of it within 10 minutes. I live in MN. What are my rights? I can't find any information on this company (either the payday loan or the collector) but I have the phone number for the collector.


Guy named Steve Cross calls from unknown number saying have my I D ready when he comes to serve me. He's already given me several prior calls to alert me to the fact that litigation is being brought upon me. Said he was coming to my house today 1-14-11. Hadn't shown up yet. I admit I actually thought someone was going to show up. But after reading a few of these blogs; I knew it wasn't happening. Gives me a claimant number to call. I called they said so and so law firm, I just hung up. Figured it was fake. What's really going on?

Did you obtain a payday loan online? FYI, a server just shows up at your door, they certainly don't tell you ahead of time.

I have a collection person calling me in reguards to a payday loan from 2002 saying they are going to turn over a notice to the IRS and have me investigated because i havent paid them back and its considered unreported income! Also the loan was in the amount of $500 they want $1000 it was written in Florida and I now live in IL what are my rights?

Anyone heard of Federal Recovery Group? They called today in regards to a payday loan in 2006. Really close the SOL on that one. I interrupted her and told her that she was calling my work. She basically gave me the same old, "Fraud charge bad check going to file with my court house today" line. I'm sure you are all familiar with it. She then asked to verify my social. I informed her that I would not verify anything over the phone. She informed that me that was how it was done. I then informed her (exact words) "Lady, your dealing with someone who has done his homework. There are laws that you are not following. Fair Debt Collect Act Laws. First off I need your Name, and license number. Are you licensed in the state of Virginia? And what is your address or website so I can verify you are who you say you are." She informed me that she couldn't provide that information. I then informed her that I was under no obligation to cooperate with her in any way.
My advice to you all. Do your homework. These guys are bottom feeders trained to intimidate you. Don't let them. Make the realize real fast that they are not going to anywhere with you. This is the third Collection agency that has tried to collect on this debt that was paid back btw. After threatening to send me to her Supervisor I said politely, "You go ahead and do that. Bye Bye!"

Caller left message that they were the police and had a warrant for the arrest of my son for check fraud. They said they had my social security number and would charge me with fraud if I did not call back with banking information. I was to reference a court docket case number and ask for extention 112. When I call, they answered William Scott & Associates, and the man with whom I spoke would not disclose the company business type, or location of the busines. He kept asking for the case number. It was obvious that his intention was to extort money, banking information, and any other info that would enable him to commit his own fraud. If you are called by this company, do not disclose anything to them. Report them to your local BBB (they have an F rating) and report them to the authorities for extortion. My son did have a payday loan over a year ago that he paid off. I think these bottom feeders have a list of borrowers that they are using for extortion.

My mom got a call and she returned the call. They told my mom that they was going to arrest me because I took a payday loan in 2005 at a place called Express Checking in Virginia and I have not paid back.I called the number and they said that the statue was about to run out and want me to pay it today and they will arrest me for fraud and I will have to pay back 5000 in charges and legal fees. I don't remember taking the loan but I told the lady that I will pay it but not today because I don't get paid today. I can pay it next week and she said no we will send someone to arrest you and hung the phone up. Can they do that?Its five years old if its mine then I want to pay it.

I can't believe this I was called on my cell phone today saying that I had a loan that I did not pay back from an online company and that I am a suspect and they are going to have a team come to my house on Monday and arrest me and take my children away until after court. I kept asking him to send me something to validate what he was saying but he said because I was a suspect they could not do that. He said I was a theif. This really upset me.

If they call again, do the following (and nothing else)

1. Ask for the name and address of the collector
2. Tell the collector that you are recording the call
3. Tell them Under the Fair Debt Collection Practices Act, a collector must send a 5-day letter stating what the debt is, why it's owed and how much they believe you owe. Tell them that you have not received this letter.
4. Tell the collector that ???Under the Fair Debt Collection Practices Act, you MAY NOT contact me further??? and that you are sending a certified letter to that effect to the address provided above.
5. Hang up
6. Send the drop dead letter (sample below) to the address via certified mail.

A drop dead letter for collection agencies that are harassing you about a debt.

To Whom It May Concern:

I have been contacted by your company about a debt you allege I owe. I am instructing you not to contact me further in connection with this debt. Under the Fair Debt Collection Practices Act, a federal law, you may not contact me further once I have notified you not to do so.

(Name)

(Account No.)



Do not answer the phone from them again.

my sister called me today and told me a pay day loan collector called her to inform her of my debt. I call that 888 number back. They said it was from global group lending intended to collect the pay day loan. I did not admit to the loan but asking them nicely for their addresses. The lady yelled at me, accused me, tell me to shut up and hung up on me. So i called back like 15 times. again she yelled at me with her nasty attitude and told me to stop calling her. she is mad ghetto. she called my 2 references and i asked her not to call them. so she tell me to shut up and hung up again. So i kept calling until it hit her last nerve. So what should I do now?

speaking as someone from the other end of the spectrum................if a financial institute so chooses to file charges against you for a payday loan then that is very well possible.......tech.............by defaulting on a payday loan you have written a bad check.............most pay day advance places will not take the time or money to file criminal charges.....however that does nt mean tht you wont look up ur credit report down the line and see a judgement against you......................at the end of the day people take responsibility for you debt........stop making excuses.........when you knw u owe.........i do agree that sometime people take the whole collection thing too far........but unfortunetly due to lack of moral or concern for their own responsibility .........collectors feel tht they have to take it to that extreme just to convince people to pay their own debt.......which is sad in itself
