Nationwide Cash is threatening to pursue legal action against me–help!

I am working to get out of the patday loan trap. For the most part, I've found these lender willing to work with me. But I called Nationwide Cash this evening after recieving a letter via email regarding a NSF return. My son was in the hospital and I have to use the funds out of my next check to pay my mortgage and daycare so I can keep working.
The representative at Nationwide Cash's "Fraud" department stated that they will pursue legal action on me if the minimum amount can't be drafted from my bank account. I no longer have overdraft protection, and I will not have funds to cover, which I explained to the man. I stated that I was willing to work out a payment arrangement, but he said if Nationwide Cash made an exception for me, they'd have to make an exception for everyone. He said that they could send out the local authorities for bank fraud. I'm pretty sure that is incorrect, especially here in Texas - I never wrote them a check - it was all over the internet.
How can I work out pay arrangements with Nationwide Cash?


Extend this payment proposal to Nationwide Cash through certified mail with return receipt requested. I hope they will be arranging you a plan if not done on the first time. They try to pressurize payment so that they can recover large amount of money at one time. Do let us know their response after Nationwide Cash have received this letter. I am sure that this will work as it does with most of the people.

One question though, do Nationwide Cash have any basis for sending local authorities out to arrest me?
I would hope not, I am in Texas and a single mom of two, so obviously it rattles me a bit to hear that!

This is just a scare tactic. They will not be sending out the sherrifs to arrest you for bouncing a check. If you became a habitual offended...or basically purposely writing hot checks to BestBuy or other stores, then there would be a reason to get the authorities called.
If at all possible, pay Nationwide Cash loan when it's due. If it's going to put a strain on your financial situation, move the funds over into your savings account. You'll get charged a NSF from both sides (your bank and the loan company), but its better than losing your entire check.
Rest assured, no one will be coming after you. You have other things to worry about...

Again, thank you very much for all your replies. This forum has given me power through support and information that I can use.
My loan principle was 500.00 - I have already paid them 500 dollars via "rolling" over because I couldn't afford to pay it all at once.
I am going to send a certified letter tomorrow to Nationwide Cash requesting that they one, validate the debt by listing the principle and interest along with a record of all payments I have made on this loan. I also asked them to refrain from renewing the loan. So maybe I can pay them off soon!
I am asking that they allow me to clear this matter up in payments, which I am more than happy to make, after they send the requested validation.
I DO have other things to worry about - my son was in the hospital, which while not a good thing, was the catalyst to me seeing the light in regard to getting out of the payday loan cycle. Nationwide Cash can take priority after my kids and my mortgage payment!

Have you got something in writing from Nationwide Cash about the loan not to be renewed? A telephonic message may not sound helpful here as it might not have been recorded in their computer system. If the person who attended your call has entered a note in their system, then it's fine. But you should insist them to give it in writing.
Also, you are supposed to get a financial statement from Nationwide Cash showing the complete break off of the amount. Most financial institutions show their statement in two different columns. One is of the principal amount and the other is of the interest charges. Each monthly payment that you contribute goes to the principal as well as the interest amount proportionately.
This summary gives you an idea how much you have paid to the loan amount as well as in interests to Nationwide Cash. So, you should definitely get a statement from the company. After all, this is your right as a part of the loan contract.
BTW, how is your son now? I hope that he is keeping a good health. God bless him!!

I sent a certified letter today asking Nationwide Cash to validate the debt by clearly listing the principle and interest along with the payments made thus far.
In this letter I asked that the loan not be renewed. I also stated that I would gladly send them a cashiers check/money order after Nationwide Cash's statement of validation was recieved.
I do hope that they reply, and that I am handling this correctly, so I can get this one off my plate too!
Thanks for asking about my son (he'll be 4 in Dec). He's doing alright despite being in a half-body cast. He's been diagnosed with brittle bone disease and his femur's on the mend. 5 more weeks till the cast is removed! YAY!

I think that you have done your part of the job that was required. Now, the ball is in their court and they will have to reply accordingly. If you don't get a reply from Nationwide Cash, then there are legal ways to handle it.
I am feeling so sad to hear about your son. OMG! My heart really goes out for him. He is going through so much pain at such a young age. God, give him some power to come out of this pain quickly.

I'm HAPPY to hear that there are other people in the world like me. This website is great. I have 8 loans that keep rolling including one from Nationwide Cash. I needed money for my daughter's dentist, then repairs on my car. I want to change bank accounts, but I'm scared that they will garnished my wages. I cant afford that. HELP!!

Thanks for praising the website.
Figuring your situation, I insist you to set up an effective financial plan with your pdl companies like Nationwide Cash and put things in order. You need to first analyze how much is your income for each month, what will be the expenses and then the plans towards solving your debt related problems. Remember, this will help you in getting out of your debt and this will be the best move if it can be done.
If you are not able to plan it, and are feeling turned down, you may need debt counseling.

I feel your pain, I have 11 loans out and it seems that I can not get out of the bind. However I did find a credit relief company that is helping me with the payday loans, so far most of the payday loans are excepting the fact that I am with a debt management agentcy. There is only a few (a very few) them that are giving me a hard time. Nationwide Cash is one of them, however, I should have relized this in the first place Nationwide cash told me that rejected the payment from the debt management company, well if i am not mistaken if a creditor rejects a payment they have to eat the bill.
Any way BOO I believe you may find help if you use the following debt management company

I recently got a pay day loan from Applepay.com. they took extra money out of my checking account every two weeks. i finally closed the account. i told them that i needed an adress to pay them off and they refused to give me a mailing address.

People are starting to . But first you have to overcome pride ( admitting you took a PDL can be a embarrassing thing) , then you have to get Pissed Off enough to take action ( sorry for the language) . Several Members of this community have done a TREMENDOUS amount to research and put a lot of effort into making that information available.

I was one who was in the pdl cycle for years. It is embarassing to talk about. There is a lot of shame involved in the situation. I am one who has done a lot of research on the matter and found out that I do have rights. Most of mine are now paid off or settled. I am still fighting a few but I too have decided to sue one lender for various reasons.

Okay I got caught up in this PDL thing also, I have 4 outstanding and the companies are willing to work with me except for Nationwide. Yes they made all the threats including jail and the law will be at my house in an hour. I panicked and borrowed some of the money to pay them tommorow but I would like more time. Now that I have read these threads I don't feel so crappy. I do feel like a total sucker for falling for their threats but I was totally stressed out in the first place. Try checking the California Fraud Alert website. Nationwide Cash has been barred from operating in California because of their illicit practices. You can file an internet fraud complaint with the FBI and also a formal complaint with the Better Business Bureau. Since their base of operation is in New Mexico, file a formal complaint with the New Mexico State Attorney, it's free and can be done online.

Lostinfl-How did you find out Nationwide has been barred from operating in CA? I filed a complaint against them with the CA AG and CA Dept of Corp. I paid them back 4x of my original 300.00 loan and they still tried to get $330.00 more and used all their ???????fraud??????? threats against me. After visiting this site and getting all the great info in it, all I had to do was to threaten them with the CA AG and never heard back...not yet anyway. Anyway, I want to find out if they are indeed officially barred so I can sue them for the overpayment. Not that I'll ever get $$ out of them I'm sure, but it's the principal. We need to put these sharks out of business and in jail where they belong! Thanks!

Melaniemc_99 I also told them I did file a complaint with the Florida, NM AG, Florida Dept of Finance Regulators, FTC and it still hasn't fazed them..they keep calling me I paid $360.00 on a $300.00 loan and they are trying to get $420.00 more out of me..I told them they could call the Regulators of Florida and explain why they want $420.00 more out of me..They used their fraud threats against me too, I especially liked the one about the employer's computer, I told them to do their homework before they send out the computer generated letter.

Thats so cool that CA has banned those internet PDLs, is there somewhere I can find out which onces are banned. I get so much SPAM from PDLs and since my work e-mail address is a california .edu address, I want to let the AGs office know when I get any PDL offer emails from those companies. CA is really getting down on spammers and they cant claim they didn't know I was in Calif- those sharks need to be in jail. Thanks!

I too have gotten over my head in the PDL chaos. I have been able to make arrangements to pay most of them, but Nationwide Cash (Langhorne Law) has been the most difficult. With other lenders, I've been able to make payments, and as long as the payments are consistent the loans are being paid down. However, Nationwide Cash demanded the full payment be made, and acted as if they were doing me a favor splitting it into 2-3 payments. They made me feel like the biggest loser and that I was the only person who had ever been in this sitution. They told me I was committing fraud and they were going to sue me for fraud. I have had a loan with them in the past for $300, which I paid a total of over $900 by the time it was paid off. Then I got a second loan for $500, which I've made two $100 payments, and they still say I owe $660. They said it had to be paid in two payments on my next two paydays for $330 each. When I spoke to the collector yesterday, I told him that I would only be able to send $150 this week, and he told me that if I didn't send the $330 on Friday that come Monday they would sue me and also my employer because I used my employer's computer to apply for the loan originally. I told him that my employer had nothing to do with my loan, and that they hadn't agreed to pay anything back for me. Can they sue my employer as well or is that a threat? My discussion with this collector became very heated, and I just told him that he should consider himself lucky that he's got a financial perfect life and has plenty of money to do as he wishes. I just told him that if he ever found himself in financial difficulty that I wished he got to speak to someone just like him and hoped that person was just as rude to him and made him feel as badly as he's managed to make me feel.

Guest, These companies have a way of making you feel like dirt. However they are the ones that are dirt in my book. There is a term that is used for this type of business they are PREDATORS. You have to become educated to fight these people. The first thing is to find out your state laws. Go to http://www.paydayloaninfo.org and click on your state and find out the laws there. Second find out if they are licensed in your state. Check your secretary of states website to confirm this. Third most important. Contact your Attorney Generals office and file a complaint. Attorney Generals are the ones that can help you. They are the legal team in your state that protects consumers. Best of Luck Kyside38

this company nationwide cash is real fraudulent.i applied for a payday loan with another provider and nationwide illegally took out 280.00 for a payday loan they said i had with them in 2004.i asked nationwide for legal written documentation of the loan but they would only email it to me they said.enforce your fdcpa rights.you have the legal right to dispute any debt and they legally have to give you written verification of the debt and sorry emailing it to you without your written signature on it dont prove you owe the debt.i have a fraud claim for 280.00 with my bank and i have read other rip offs by this place and most others eventually in 7 to 10 business days get their money back.dont let their scare tactics get to you.i asked one guy for a written history of my acct and he said their system dont go back 5 years.he said call your bank because your bank has proof you owe us the money.they dba as ambassador financial.i would reccommend not doing business with this place because you try to calmly explain to them whats going on and they tell you to quit tripping and calm down.they are totally arrogant you know whats.dont let them get to you.these guys dont know laws like attorneys do.enforce your legal fdcpa debtor rights and ignore these jerks because they are not attorneys.dont agree on the phone to pay them anything until they can give you a registered certified letter and history of your acct in writing showing how much you owe them and when they offer to give you proof of debt in an email like the guy demanded instead of in writing enforce your legal rights and demand it in writing.

Oh my gosh! I know what you mean about them taking money out of your account. I had the account with them 4 years ago. I have a new account now and they somehow managed to withdraw money out of my account without my permisson on my new bank account that had nothing to do with them! Are they allowed to withdraw money out of your account without permission from you? Anyways, this guy Jimmy Blake was rude as crap! He kept asking me for my debit card and he said that he got my information from a watchdog system which is how they pulled the money out. My bank told me I can file an ACH stop payment form to put the money back and an ACH Revocation form to bar them from taking money out of my account again. I was so mad when I checked my account his morning, now I have to make a tripto the bank to undue the damage.

Do not worry. I have a payday loan with Nationwide and they are bullshit. They will not send out fraud investigators. It is just a tactic. You can write a cease and desist letter and they will have to send everything in writing. It is just a scared tactic by them. I pay them once a month and if they do not accept that then they can call the authorities. Read the Fair Debt collections Practices act online and you will see that they have violated. They can be sued.
