Have one with ameriloan and I am making my last payment of 65 this week.

Help...I have been in this HELL for a while now. It is an addiction it seems. I dont know what to do.
I did fax a letter to MTE, Arrowhead, and Cash Supply revoking authorization for all future withdrawals from my checking account. Also stated that I will make payment arrangements with them.
For some reason I dont think this is going to help.
Also, I have to keep some sort of account open at my bank as I have a loan thru them and they take it out when my check is deposited in my account.
Please help ;( This is all I think about and feel so stupid and helpless.


I read on here that PDL's are illegal in NC. When I am talking to these people to make arrangements, can I use that as a barganing tool. What I am having trouble with is standing up to them and not falling into a payment plan that I cant afford.
Just wondering if anyone had any tips of what I can say or send to these people.

candis, first of all, pdls are prohibited in your state. Second, most (if not all) are unlicensed/illegal companies. Of course this is a bargaining tool. They are operating illegally lending to residents in a state where pdls are illegal. Your first step is to do SOMETHING with your bank account. I understand that you've sent letters to your pdls. However, these guys are not going to cooperate. They are going to continue to debit your account until they feel as though they're done (which is never). You need to do something. If you have a loan that is debited through your bank, that's fine. Can you CLOSE the account that you have, open another account, have your check deposited into the new account, and contact your loan company and give them the new account information? You need to stop the pdls from having access to your account. Like I said, since they do have access to it, they're going to continue to debit. They will not abide by your requests in the letters sent. Take my word for it. Please post back regarding your bank. There is a "sticky" at the top of this site page regarding closing your bank account. Please read that carefully and post any questions that you have. We can help you through this. Just sending them letters will not do a thing. Also, once we get your bank account to where the pdls no longer have access, we can send out letters to them, and we can file complaints. Please post any questions. We're here to help you.

I just spoke with my bank manager and he closed my checking account. I cancelled my direct deposit from work. They said they would help me any way they can. I do have to keep a savings account for the loan to be deducted when I get things set back up with them.
So now I have to deal with the myriad of calls I will be receiving. MTE is already responding to my fax and wants me to call them before noon tomorrow. I have not spoke with them yet as I wanted some suggestions from you guys.
I really appreciate the help.

Candis, Do not let any of the callers pressure you into anything. They will threaten to have you arrested and everything under the sun. They can not do any of these things. Do not take phone calls if at all possible. Let them leave messages and keep notes regarding the messages. When you send the letters Cannr refered to you will tell them to contact you by e-mail or usps only (whihc they will not do) you want to try to only communicate with them in writing so you have the documentation for compaints. If they call and you answer, tell them you are not there and note the date, time and name of person who called and any message they leave and then respond to them in writing.

candis, do not speak with the pdls via telephone. As roxy posted, do everything via email or USPS. I got your message on my home page. Do you know how to use pm to send private messages? Underneath my post you will see a little button with 2 people on it that says "pm". Click on that. It'll come up to where you can send a message directly to me. When negotiating the balance on these as paying principle, do I subtract what I have already payed them off of that? For example...I have paid Arrowhead Financial $270 in fees on a $300 loan. Does that mean that I should only pay them $30 more dollars to be done with that? I know this is on my terms and there is possibly some negotiation. I faxed letters to them stating what I have already paid and my balance. Arrowhead has already called even though I told them not to. I didnt talk with them. I have a feeling this isnt going to be easy. Where do I go from here if some of these places do not reply with a counter offer or even an address to send them the money?

candis, you are correct. You owe Arrowhead $30, honey. They can pretty much bite you if they want more. Do not agree to a penny over the principle amount of the loan. Whatever they deposited into your account, subtract what you have already paid them, that is what you owe/have overpaid/whatever. Not one cent more than the principle amount. If you need addresses for any of these pdls, just post who you need. We can find them for you. If you have any questions or run into any problems, just post or send a pm, okay? :wink:

In my first post I said I was going to pay off ameriloan today. This was when I was still feeling intimidated by these creeps. I am going to send them a letter as well stating that I have overpaid them. Can I use the same one you gave me cannr? Just tweak it a bit? Do they ever send overpayments back???
I received 250 dollars from them in July and have paid them $420 to date!!! Payment arrangements my FOOT!
Thank you all for your help. After I get these creeps I am going to start repairing my credit report. If it wasnt for this site, I was going to declare bankruptcy.

candis, send the letter. Of course, "tweak" it to fit your situation. And anyone that you have overpaid, by God, certainly feel free to demand a refund of the overpayment. Can't say as you'll get one, but hey, I would certainly put it in the letter! Some pdls will give refunds, some won't. If they give you a PIF, consider it a happy day! However, MTE related ones normally do not give refunds. They want more even if you've overpaid. Gotta love them. :evil:

I think that is it. I am working on my AG, FTC and BBB reports now and mailing the cert letters that I have already faxed to these jerks.
Today I had CashSupply AND United calling me. I guess they didnt get my fax...haha. So I faxed them again and emailed them my letters again. Midland sent me a email stating they were turning me over to a collection agencey. I hope they do. What is it that I can send them when they do that?
