Ms. Scott: I forwarded your email to our Legal Department. Here is their response: "I would advise Ms. Scott that when she accesses our website, her business presence is in the State of Nevada where the actual transaction is processed. She is, therefore subject to the rules and regulations of that State just as if she traveled ther in her car and opened the account. Furthermore, an attempt to knowingly defraud a licensed lender across state lines is a crime and the dollar amount involved makes it a FELONY." I suggest you contact me at your earliest available time in order to make restitution for the money you owe us, which is due on Friday, May 19, 2006. My toll free number is shown below. |

The state laws in Nevada prohibit the lenders from charging the consumers excessive interest rates and fees. This is the same as any other laws in the US. This law has been enforced by the State Financial Institution Division in Nevada.
The new laws state that the consumers who have defaulted three additional months should not be charged anything more. In case, the person defaults further, he can be taken to the court, but the interest charges on default would be about 16 percent. This law has been passed so that the slimy companies don't continue with their abusive business of charging higher interest rates and hidden charges from the consumers.
Get the statement of your account from your lender. Check if they have acted as per the laws and charged permissible interest rates. From there, you should think of moving further.

Additionally, bambi, they are wrong as most states apply a long arm of the law interpretation for internet busines taking the position that their citizens are governed by their laws.. There have been court cases holding that principal up.. so their so-called legal response is all smoke and mirrors, as is evidenced by standard collection tactic 1)A- threats of criminal action.. not true.. all BS
