Okay I have a question isnt it illegal for a company to disclose any information reagarding a debt on a answering machine or VM for instance this is the message I got on my Voice Mail on my cell phone that he doesnt know that it is mine:

I'm am trying to reach ( my name ) Hi my name is Mr. Kay National Payday advance with his phone number. It is very important that I reach amber because I am going to file a crimial and civil suit against her in court for freezing her bank account (which I didnt do the bank did) and that is third degree something or other I dont remember what the heck he said but he went on to tell my voicemail may I remind you he doesnt know its mine but went on to continue to tell the whole story there.

This was after he called my work and to me and the owner ot my company that he was going to tell the police to come and arrest me.


Ok, I counted a total of nine fdcpa violations left on your voicemail. I hope you saved this voicemail becaue you have it as evidence of this agency completely violating your privacy and civil rights.

1. They can't disclose a company name on a voicemail.
2. He can't say he's going to file a criminal suit because that isn't true.
3. He can't say he's going to file a civil suit either because that can't be done as well.
4. He can't say anything about you freezing your account.
5. He can't leave any whole stories on a voicemail.
6. He can't call you at work if you won't have that.
7. He can't tell your boss anything about why he is calling.
8. He can't threaten a false arrest.
9. he can't tell your employer about threatening to do a false arrest.

What you have just posted is a detailed labyrinth of sh!t. Find out what state these imbeciles operate in, contact the Attorney General of that state, complete with all these details, and go bust some heads.

Above all, you don't even have to deal with such charlatans, especially with a payday loan, you can make your payments directly at the place you borrowed the money from.

It is illegal for a collection agency to leave confidential information in a voicemail. Anyone can have this info and that violates the fdcpa laws of disclosing confidential information about you.

The only way of the company can escape this matter is if they have a specific written permission from you to discuss the matter with your answering machine.

If you have already put a cease and desist communication, the laws have already been violated. The company is trying to scare you with their illegal collections. You must report them to the FTC and the BBB as well as the state attorney general office in your state.
