Can someone collect on a cheque if they already have picked up the items that the check was for?

Hi Theresa

Welcome to the forums.

If the check has already been cashed, it can't be cashed twice. There might have been some mistake done by your bank while entering the data.

Contact your bank if this has happened with you and request them for verification. It is a small thing and can be corrected easily.

I think what she is asking is, if she wrote a check for goods that bounced, and the goods have been returned or picked up, can the establishment that you wrote the check to also try to collect on the check. I would say they might be able to collect the return item fee, but not also the amount that the check was written for. That sounds like fradulent activity if that is what the company is trying to do.

If the items were returned, though, you receive cash back on items paid with cash or a check. So yes, the store will still have a right to collect on the check. I don't quit understand what you mean by picked up though. It's a toss up...usually if the items were picked up by someone else, such as the police, the manager on duty (or whoever) receiving the items, will more than likely forget to call the accounting department to tell them items from a Theresa have been picked up. Tear the check up....or whathaveyou.

I would contact your bank to see if that check is still pending, and contact the store as well.

Mike
