Question regarding Ohio payday loans
Date: Mon, 05/21/2007 - 18:05
I'm from Ohio, and I've had my storefront pdls with T&C's debt management program for 2 months now. Even though T&C has contacted my pdls and have sent proposals and payments to them, they are still calling me at home and at work daily. I've even sent letters of cease and desist to the pdls asking them not to call me at work, but they still call me at work. One of my pdls has even started threatening to send my file to the county prosecutor's office! Does that mean they are going to have me arrested?! T&C has told me that I cannot be arrested for default on pdls, but I must admit that I'm worried about what could happen to me. T&C said the worst that could happen is that the pdls take me to civil court. Anyone here who's from Ohio ever had this kind of problem even though you had your pdls in a debt management program and payments are being sent to the pdls? Any insight and/or advice would be greatly appreciated, thanks!

One-you cannot be arrested in the state of OH for defaulting on
One-you cannot be arrested in the state of OH for defaulting on a PDL, two-they have to allow you to make a repayment plan...The most they can do is civil suit you to get their monies back....I would file a complaint on them with the Attorney General as they are required to follow OH state laws

Do as Leah says and file that complaint with the Attorney General. Several people on here are from Ohio and are working their way thru the payday mess. Send those complaints in the more the better. They will use every scare tactic they can to keep bleeding you dry. You are not going to jail and most likely not even to court unless its a storefront loan. There is only one internet that is licensed there. PM Steelers for the name of that one. I forgot it. KYSIDE38
Here is the scenerio that would get you arrested in OH: You go
Here is the scenerio that would get you arrested in OH: You go to several storefronts and take out loans (within the same day or within a few days of eachother), and then turn around and close the account before they are due. Since that is probably what you have NOT done you should not worry. Which companies are you dealing with, some will threaten you with arrest. There is one company that does threaten jail. As another member has been through this with the company and was told by employees at the storefront that when it comes to the end of the month they start laying it on thick in the collections dept. because they want to make their commission on what they collect off of you. Have you tried working out an agreement with them yourself, this particular member did and was able to pay them off by paying what she could afford and going to the store each pay period with her payment.
I have spoken with people at the Dept. of Financial Institutions
I have spoken with people at the Dept. of Financial Institutions, and they have said that these storefronts can not prosecute for a defaulted pdl because it is an unsecured loan.
