My situation is sort of bizarre, but let me tell it to you.

List the companies you have the loans with and whether it is a store front operation or an internet operation.

Four are storefront operations
THe other two are internet loans: AMCash collections, and PaydayOK


List the original amount of the loan for each account
Storefront 1. 800.00
Storefront 2. $800
Storefront 3. $400
Storefront 4. $300

Internet:
Payday OK $600
AMCASH COLL $300


List what you have paid so far for each loan.

Nothing to storefront 1,2,3, and $50 to 4.

Payday OK-$200
AMScash COLL-$100


List what state you currently reside in.

Okay, here is the situation, I recently found out my wife is in debt to the above companies by getting a phone call out of the blue from one of the companies asking where her payment was. After talking to her she told me that the storefront loans have been going on for years, as she takes her paycheck and basically gives it to one, and then borrows from the other,, etc... The internet loans are recent both in the past three months. In addition she has a loan from cash call for $2000 which she will basically pay back $8000 over 3 years. I do not have the funds to bail her out, but at the same time we cannot keep living like this, as it is having a direct effect on the ability to care for our children. I recently put my house up for sale, but the market is slow, as I thought selling the home and paying these laon sharks off would help. My wife realizes that she has a problem with spending and is now undergoing therapy, but anyone have any idea about what I can do about this mess? I cannot get a personal loan to pay off the cards, and we already tried to get a 2nd mortgage and were denied. If I stop paying these payday loans what will happen, and is that the best or only option to break this vicious cycle?

You should be able to email Payday OK and get payment arrangements with them. I would inform them that their company company is in violation of Ohio Rev. Code Ann. ???????? 1315.35 et seq which states that there is no rollover allowed and may only charge interest rates of $15 for every $100 loaned. I would ask that they allow you to make payments towards the principle and then be considered paid in full. I found them to be very easy to work with and it can all be done in email. Let me know if you need help with them. I am in Ohio as well. I do believe if you borrowed $600 from them, you need to repay them $600 but nothing more since they are not licensed in Ohio.

I dealt defaulted with First American and Cashland. First American wasn't very willing to take payment arrangements. They actually deducted the amount I owed them out of my account electronically after I told them I would be in to pay them on the following Friday so watch out for that!!! Cashland will send you to their in-house collectors and they will make payment arrangements with you. However they will want more than you can afford. Once they see that you can only pay so much every week, payday, etc., and as long as you are making regular payments towards your balance and you keep in contact with them, they will work with you. Just stick to what you tell them and don't miss any payments. Don't avoid their collection calls though because they do not give up.

Check Into Cash is a member of CFSA. Becuase they are a member of CFSA You can get an EPP (extended payment plan) with them. What this means is that you can go to the storefront BEFORE the due date of the loan, invoke the EPP. When you invoke the EPP, you will sign an amendment to your loan documents. This amendment will list a payment plan to repay the loan amount in 4 equal payments until it is paid off. There will be no more fees added on and all collection activity will stop. As for ACE, I would try to make payment arrangements with them.

cturner, you're probably thinking the "pdls in general" are legal in Ohio because Ohio does not prohibited pdls. They have storefronts. Sassnlucy lives in Ohio. Sassnlucy has dealt with both internet and storefront. You can trust her.

So, is she saying that all internet PDL's are illegal or not?? I'm sure this is not the case. Actually i'm positive that is not the case. I think she may have been referring to the internet PDL's the original poster was talking about and not online PDL's in general. Sorry for the confusion. I wish they were illegal in Ohio.

cturner, you're correct. I read her post regarding PayDayOK. What she was stating is that PayDayOK is not licensed in Ohio; however, PayDayOK is licensed in another state. So she was stating that PayDayOK needed to follow her state law regarding rollovers and fees. Some internet pdls are not licensed anywhere. No license = illegal. So it would depend upon the internet lender. For example, CashNetUSA is licensed/legal. For example, One Click Cash is not licensed/legal. So it depends on the actual internet pdl.

Internet payday loans are legal in Ohio, if the company has a license in this state. Payday OK does NOT have a license to do business in Ohio. However, some internet lenders do, such as CashNet USA. I hope this clears things up. Also, if you are dealing with an illegal lender in Ohio, please contact the attorney general's office for assistance. They helped me out with all of my illegal internet loans and they are really serious about helping Ohio's consumers. :)

Tes, if you communicate with them and try to make payment arrangments with them and keep them, they are not going to file criminal charges against you. As long as you keep in contact with them, they will have no reason to contact anyone but you. They will contact your references if you do not return their calls. I have defaulted on quite a few storefront loans and none of them filed criminal charges against me. They never contacted my employer either but they will go to every length to get in contact with you if you don't communicate with them.
