CA calling for a debt that my company owes

Over two years ago I rented a car for work. It was a small company so we did not have company credit cards. As we were pulling out of a parking space, a passenger noted that something seemed to be dragging underneath the car. We all got out and discovered that the front bumper was detached half way. Well, the car was unsafe to drive in that state so my co-worker removed the rest of the bumper and we drove back to the rental car agency, filled out the paper work, and got a new car. We attemped to reach them to see if they needed anything else from them and never heard from them. Fast forward over two years - Last week I get a phone message from a collection agency. I forwarded them to my old employer - I no longer work there - and I just got another message from them today that they were unsuccesful in reaching the employer. I guess its my liability since it was on my credit card, but I was renting and driving for work, so its my firm's responsibility, but then again, the rental car company at that time didn't ask us me to pay either. Heck, I've been renting from them all this time, so I don't think it would have been difficult for them to find me. I will call the collection agency tomorrow and ask for proof that we owe this money - as in proof that it was our fault that the bumper fell off.


The collection agency will be able to prove the debt since it is charged in your credit card. But I am assuming that you will not be able to prove the CA that it is a company's liability.

Have a talk with your previous employer and arrange for a reimbursement. If the records say that you were entitled to use the car on behalf of the company, they will have to pay the amount to you. You can in turn pay back to the collection agency.

But the collector will only contact you because it is charged to your account. So, you have to make arrangements with them and improve your credit ratings.
