HI im not sure if this is the right forum to post my concerns.

Orchardbank has been charging me fees other than late payment fees, and overcharge fees.

The way they charged me was little fees such as ACCOUNT SECURE, IDENTIY PP, CHECK BY PHONE ($12.95!!)

I only have about $300.00 and i only used it 5x at the most. All thse little fees adds up. While they add up, they charged overlimit fee.

All this goes on for month after month after month. Every month i called and checked and told them i dont want these IDENTITY THEFT fee and they won't remove it. I only have $300 Limit to my accuont. They charged me so far: $90. for this alone.-$10 each month

And when I asked them to close down the account, they wouldn't. they wanted me to pay the whole thing off before i can close account. Meanwhile they still charged me all these fees.

ive been a member since earlier 2005.

Their commercial is 100% Lies

do i have a chance to sue them?

Im so angry, all i wanted to do is to build up my credit and theyve ruined everything

On your statement where they bill you for the account secure and identity theft there should be 800 numbers to call and cancel them. They are separate numbers from the Orchard number. I pay my account online so there is no fee. You can also see your statements and everything online and manage your account. Check and make sure the account secure and identity theft whatever are canceled. If not, keep calling until they are. They should refund you some money. Orchard is bad about over the limit fees. They will charge you immediately. They will also charge you multiple over the limit fees a month.

Orchard is one of my credit cards. My limit was $500,but due to late fees, which created over limit fees,I now owe them over $1000.I got charged late fee even when I paid my bill 7 days early. They said it was not posted until after due date.Companies like these make thier money off all these fees.I have since joined a consolidation program and so far everything is going smooth.

Please check your agreement papers, perhaps their fee structure is explained there. If you find they are violating the agreement, you can definitely sue them.

There should be some way of canceling identity pp, account secure options, I guess. Speak to the higher authority and explain the problem. Best of luck.

Some people are lucky enough to not have charge accounts or can PAY OFF the accounts and live a "debt free" life. Unfortunately, they are far & few between. There is an 800 # to call and cancel the Payment Protection Plan. That is one plan that is useless, unless of course you happen to become disable after your required wait period. I would review your records that you signed B/4 and after they approved you. If, you feel you are right and they have charged you in error and over the fees stated by law there are lawyers out there who can help you and give you the advise you so desperatley need. GOOD LUCK!!!!

It's interesting because Orchard Bank was oneof the ones I don't usually have a problem with. I pay online every month with them and if there is a mistake, I call them and they fix it. Now if you signed up for naything either through their website or even other places, you have to reads the fineprint. Alot of times there will be little boxes at the bottom that say something like "Yes! Also include me in......." and if you hit submit, it's over and you have to go back and call all these places. I usually call and start the conversation with something like "Please let me apologize now if I sound rude, I know it is not you that caused this" Usually that sets the tone and they are very receptive. Most of the time they can help, if not ask to speak to a manger. Sometimes they will tell you that they need to take your phone number and call you back. If they don't within 24 hours, call again and refer back to the day before. Make sure that they have notes on your account that says you called and what the conversation was about and ALWAYS write the time, date and who you spoke to down for your own reference. Eventually you ill speak to a manager and it should get worked out. Hope this helps! :D

Almost forgot, regarding the pay by phone fees. If you do a Quick Payment where it gets credited the same day online they charge the $12.95, I usually use the one that posts in 3 days but they still credit it on the day I put it into them. I almost NEVER pay by phone because they charge so much for it. I did once however, make a payment online and when I spoke to a rep said that I wanted to increase the payment. She said "Oh no problem, I will do that for you" What she neglected to tell me was that it got changed from paying online to a pay by phone! I of course called them immediately and complained about what had happened and they took care of it right away! Good Luck!

I have to say that Orchard bank has been really good to me. I started out with a $300 limit and now I'm up to $1400 and I have not ask for a credit to raise my limit. I pay them each month online and it is posted the same day. But I have heard of others that do have a problem with them.

You can't be late and cannot go over limit. As long as you stick to the rules its not very expensive and a great way to build up credit.

OB was the only card I was able to get about 6 months ago and have not had any problems so far.

I was told by a financial advisor that used to work in collections, and worked also for various credit card companies, that Orchard Bank is one of the first to sue, especially since they mainly give cards to people with bad credit. So, be very careful with these guys. I don't have a card with them, this is just what I was told. Capital One is another he said will sue very quickly.

I had a problem with Capital One in 1999. Actually due to my own neglegence I was late paying for a couple of months and the fees racked up. I still paid but since I was late they charged a late fee.

It ended up accumulating to some unreasonable figure like $800 for only a $200 credit line. When I refused to pay it went to collections and I ended up settling with them for something like $400 or so.

This was back in 99 so the laws may have changed on what they can charge ( sounds more like a payday loan than a Visa Card )

So yes be carefull with these poor credit Visa's as they will try and stick it to you. I have been current with my Orchard Bank card and have not had any problems so far.

If you pay Orchard ontime their fees are pretty good. Its a card usefull for building up credit so make this a priority.

I have a unsually maxed-out $300 limit and my payments are around $21/month with only about $5-$6 of that in interest. Beats the heck out of a payday loan.

Read the contract carefully. If you "used, applied for, or requested" a credit card with prior knowledge of the terms and conditions, you bought into a package. If that package says they can charge you double on days when they feel disposed to do so, then that's the contract. It amazes me that people sign up for things like agreeing that South Dakota law applies or for mandatory arbitration (which is never ever good for consumers).

I understand how you feel. I am sick and tired of customer service reps that can't go beyond "i'm sorry, there's nothing i can do...is there anything else i can help you with." no! Fix the problem!!! That's all i want them to do. And stop charging me for nsf payments...my account had more than enough to cover the payment, plus my bank has no record of capitol one being paid. No body knows nothin!!! What is going on?????

I applied for a credit line increase over the phone and they approved it. They also charged me a $25.00 fee for processing the request. When I complained I was basically told to F**K OFF by the Orchard rep becaue I requested the fee and everthing comes with a price. I hope he remebers that when his girl gives him the clapp.

I too have had the same experience. I paid my acct on-line and they put a hold on the funds from my checking acct but have not yet actually applied it to my Orchards acct and they have charged my a late fee and overlimit fee. Yet they have the funds available to them. On top of that I sent a cashiers check paying the acct. off and realized (too late) that I have over paid them by 100.00 and although they have recieved the payment they said that they will hold it for up to 14 days before applying it and sending me my overpayment back. What type of practice is this. this must be illegal, surely immoral on many levels.

I am sorry you guys have had so many problems with OB, but, I, fortunately, am not one of them. I have had me card for over a year and they have been great. I pay them with my online banking and they get the payment and apply it to my account the next day. (And that is free! Can't beat that!) I had been charged an over the limit fee once, but it was because an item that I had returned, the credit hadn't posted yet, and a finance charge put me over my credit limit. When I emailed them about it, they refunded the fee the same day! I always pay way more than the minimum payment, but like you guys said - I am using them for what it is - to rebuild credit.

I didn't realize that there was any fee for either one of these, I wish someone would have explained it to me before I even received the first bill. I haven't used it alot yet.

Orchard bank is one of the worst credit card companies ever. It has had a lot of complaints against them since they are HSBC. My friend has the same card you have and anytime she misses the payment and its due that day she gets called from them. Another thing is they charge you fees no matter how early you pay them. She sent in a payment twelve days ahead and still she get charged late fees. So obviously they are screwing alot of people out of money.

My wife and I have several accounts through HSBC, one being a Orchard one. I HIGHLY recommend to never deal with these people. We are currently in a dmp, and HSBC is extremely hard to work with!! They call several times a day, sometimes within minutes of each call, and you tell them over and over what is going on and to note it on each account we have. The next person calls and says nothing is noted on any of the accounts; and the cycle starts all over again!! Stay FAR AWAY from anything with HSBC on it!!

I have had my Orchard Bank card for almost 2.5 years nwo and have never had a problem. ANY credit card company you work with has their issues on not paying on time. Don't push the envelope with these companies by playing with fire on the payment dates. Just make sure your payment gets there 3-5 days before. I use my bank with online bill payment. I started at $300 credit limit and now I am at $1700 with them. If you max out the card then pay it down, when you are at around 20%, they raise your limit by $200 usually.

Here is how I deal with Orchard Bank. By the way, I have been a member since 2005 also.

First of all, they said that they would review my account periodically to see if I could get a raise on my credit card (a limit of $300). I never got a raise in my credit limit even when I asked.

Second of all, they now convenient charge you $30 in over limit fees even if you went over a penny. I got charged that one month and was in a state of shock because they have never done that before.

They will charge you $59 annual fee which again, I didn't know there was an annual fee.

You pay online, you better make sure to make your payment two days before the due date because the payment online does not post on your account until 12AM the following day and is visible online at 12AM the day after that.

I had the same problem you had in terms of identity theft, plus packages and those dreaded "if you get a hair style, send us the receipt and we will send you a check back". For $99 per year, you can have this service. I quickly cancelled each except for one and was charged, get this, the $99 on my credit card, causing my limit to go over the limit.

When dealing with Orchard, keep a few things in mind:

-Orchard Bank will correct a mistake promptly if they are called on it. One of their services failed to cancel my subscription and I was charged for it on my Orchard card. I contacted them on Monday and they corrected the problem by Wednesday.

-Make sure to make your payments to them in advance. If you have to use Quik Collect, it will cost you $12.95 and I believe Orchard charges you something as well for using this service. Also, do not make payments over the phone as that is a charge as well.

-Keep your receipts and continously check your credit card online at www.orchardbank.com. That is the only way I discovered that there was a problem when I went online to check my credit card.

-Look to see when your card was established. See the month and the year. Remember that same month next year, you will get charged an annual fee.

I hope this helps you and good luck.

i agree with all you said Alexandra, they same things happened to me, even though i thought i was being wise and canceled my account a few days before my "anniversary" with the credit card, i was still charged the $59 annual fee...now it is on my credit, i have been being stubborn and not paying it, but obviously it had done more harm to be this way

smart advise---DONT EVER GET A CREDIT CARD FROM THIS COMPANY!!

I pay my Orchard card online directly from my checking account and it takes anywhere from 5 to 7 business days before it is credited to my account.
