Hi Htgt123

Do you mind posting the good news here?

Good News
I didn't call him back to find out what the good news was. He just stated that he had good news for me. The phone call was really scratchy and hard to hear. I new it wasn't true. I believe this is a new tactic of collection agencies. He didn't state what company he was from or anything like that. That is why I came to this site first to ask. You guys are awesome and the information is so helpful.

I was a bit in a surprise that OSI having some good news for you. Lots of complaints are posted against them. If your accounts have been paid as per your request and in true sense, I would have definitely spread the word.
Htgt123, I know that you will be cautious while dealing with them. Please do all your correspondence in writing and do not get intimidated. They will try to bully you but you are aware of your consumer rights as per the fdcpa law.
Best wishes

OSI purchases junk debts of the consumers that are out of the SOL period. They try to offer settlement on such debts by re-aging the accounts. They also misreport the 'open date' and 'date of last activity' on an account. Apart from that, harsh and abusive language is a part of their collection activity. All of these actions are a violation of the fdcpa laws.
- When they call you up, do not get the feeling that you are doing the wrong thing. Stick to what you are saying and feel that they are violating your rights.
- Keep all the letters of correspondence, account statements in safe place.
- Until your debt has been validated, never update your contact information with them. Do not arrange a payment plan before you get the true picture of your debt.
- Also, keep checking your credit report regularly.
- If you wish to take any legal actions against a company, make sure that you hire an attorney that specializes in lawsuits for FDCPA and FCRA violations.
And if you have any queries, remember to get it discussed here before you make any decision. :D

Thanks for the Info
Thank for the information. It is very helpful. I am assuming this is for a payday loan, since credit cards deal with more prestigious collection agencies.

You need to be very cautious while dealing with any type of collection agencies. It does not matter much if the debt has been sold by a credit card company or a payday loan company. The real important thing is that they should work under the laws of the Fair Debt Collection Practices Act.
Best wishes

Update with OSI
So I called this morning and it for a Citibank Credit Card. The gentleman I talked to, was named Jesse Schade. He wasn't to bad to deal with. But was very anxious to get a payment today. But I told him I needed to validate the debt and he stated it was sent on Sept 23, 2005. But I can't find anything yet. He wanted a whole bunch of information and I wouldn't give it to him. I told him I would call back by Friday after I reviewed the information. I asked for there fax number but he wouldn't give that to me either.

Hi Htgt123
Do not make payment arrangements until the debt has been completely validated from their end. You need to know the actual amount on which you are paying. Ask them the address on which they have sent you the debt validation letter on Sept 23, 2005. But if the address is not updated, don't do it until it gets validated.
I am sure that as long as you are willing to pay this debt, they won't be able to harm you in anyway.

Citibank is the company that refused the proposal with my debt consolidator. Yeah I wouldn't do anything until you validate that debt. And the only reason he is so anxious to get money is because they get paid based on how much they collect.

You have a right under the Freedom of Information Act to request information any Government Agency (i.e. FTC has on any company. I recently did this with a FOIA request to the Federal Trade Commission about Superior Asset Management and received ALOT of information.
FOIA requests are free for the first 100 pages, then they charge a per page fee after that. 100 pages should give you a decent idea of the type of company you are dealing with, the depths to which they will sick to try and collect.
Here is the letter I used. Feel free to use it and change it to meet your needs.
Freedom of Information Act Request

Dear Sir/Madam:
This is a request under the Freedom of Information Act. I request that a copy of the following document(s) be provided to me: All consumer complaint documents as well as any investigative records for the years 2002-2005 concerning ACME COLLECTIONS, located at 12345 Low Life Road, Nowhere, NE. This company is a Collection Agency.
In order to help determine fees, you should know that I am an individual.
I am willing to pay fees up to $50.00 if you expect the fees will exceed this, please contact me before proceeding.
If you need to discuss this request, I can be reached at (555) 555-1212. Thank you for your consideration of my request.
Sincerely,
John Doe

I changed the Name of the company and my address, but the address for the FTC is the correct address.
If you are not willing to pay anything, state that and they will send you what you are entitled to for free. If you are willing to pay up to a certain amount state that amount. If your request will exceed that amount they will call you and give you the chance to change you request.
They then send you your information along with an invoice (if applicable). The invoice must be paid within 30 day of receipt of the information requested.
You could also alter the letter and use it for requests from other agencies as well. Hope this is helpful.

Mikeq,
Do not opt for debt settlement program if you can afford to pay the monthly installments in the consolidation program. These programs will offer the monthly payments suitable to your pocket.
Debt settlement is considered to be a negative remark that remains in the credit file for 7 years. It will tarnish your credit report and you will be facing difficulties in acquiring new credit in the future. Read this article to know the functioning of each program and then decide which one will be preferable to you.

Wage garnishment is possible only if there is a judgment against you. You must receive orders from the court 20 days before the hearing and present your defense. Only after hearing you, the judge will decide if there is a need for a judgment.
Basically, this legal action can be taken only after analyzing your present financial situation. If your income is low and you have other necessary expenses to meet each month, the judge will be considerate towards your situation.

OSI is not just a junk debt buyer. They hold many 3rd party contingency contracts with government agencies, including many student loan guarantors. Less the 25% of their business is junk debt. The rest is educational, government, 3rd party placed credit cards and lots of utilities...and some medical.
