Paying back a debt, but agency keeps calling

I am not sure about this, but if you are making monthly payments even if it's $10, then isn't it considered harassment if the agency continually calls regarding your bill? I have a medical bill that went to collection 2 yrs. ago, and I have been making monthly payments of $10-20 but I keep getting calls regarding this bill. Now I know they want all of their money and will get it but this the only way I can pay it off. Is this considered harassment, when I am paying my debt and still being called at least 2-3 times a week? I would just like to know what to do?

Perhaps, the collection agency might be insisting you to increase your monthly payment to them. Do you have the agreed amount signed in paper by the collection agency?

If you have proof that acknowledges the CA has agreed to this plan, they should not have reasons to call you again unless you default on the payments.

Basically, no collection agency is allowed to make repeated calls even if you have defaulted on your payments. They are allowed to make calls with a genuine purpose and come to the point without harassing the person.

Have you talked to the person and requested for the reason of the call? Clarify the reason before you intend to take any legal actions against them.

You can also record the phone calls with the date and time along with the name of the caller. Do the recordings after checking the laws in your state. Some states allow recording the calls secretly whereas some states require permission to be taken from the other party before recording.

Consult your attorney for some legal advice as well. He will let you know on how to handle this situation further.

Well, I **used** to think that as long as you were giving collection agencies something every month, even if it was only $20, that they couldn't turn it away because you were giving them something. That as long as you were giving them something, they had to
accept it and settle for it. Because it was an attempt on your part. But thats not the case anymore. years ago it was, but not so much now.

If they're not happy with the amount that you're sending, then they will call and continue to call, unless you put it in writing for them to stop calling
you. You have to put it in writing to them. Tell them you will be happy to talk to them but through written correspondence ONLY. no phone calls please. Then see if they'll write and tell you what they've been calling about.

If you want the phone calls to stop, you have to write and tell them to stop. Shirley

Medical Collection companies are different, but are still required to follow the laws. Have you called the medical facility and asked for copies of the patient records? Usually, the collection company would have to submit any copies of whatever they're collecting on. But due to patient confidentiality, it is the responsibility of the patient to acquire these.

Another thing I'd like to add about medical bills is if you speak with the patient accounts department prior to it being sent out, and tell them...."I cannot afford this bill. I have no additional income to pay this. I need help." You can only say this if you truly cannot afford the bill. But in most cases a "charitable application" will be mailed out to you, and chances are the bill will be removed.

There are so many things that can get a medical bill wiped out, because the hospitals are already making millions by the insurance companies.

Also make sure that in the patient records you receive, that your signature is on the patient responsibility line. Even though the debt is yours, chances are it could be removed because your signature is missing...because the clerk didn't go over the billing policy with you.
