500fastcash update
Date: Thu, 10/23/2008 - 10:35
Just wanted to give another update. The state of WI sent them this e-mail today to their "Compliance" department as well as the fax # I highly doubt they will answer but will be intersting since gave her all required documentation. I also gave her my statements from when CheckNGo, cashnetusa had my account they will be contacting them next (Found out they tired debiting my account three times when they were only suppose to twice once they realized my account was over drawn. Will give an update on that.
As far as checkngo.com & check'n'go stores, I think they are seperate since I filed a complaint w/ bbb checkngo when i received that call last friday, said I haven't had a loan with them since 2002, when I did take another one out in 2006. I will provide another update when I hear back from either party. Btw, this is the email that she sent: I bolded part that I highly doubt will ever happen.

Dear 500FastCash.com:
We administer the provisions of the Wisconsin Consumer Act, chapters 421-427 of the Wisconsin Statutes. The act governs consumer credit transactions and the collection of consumer debt. Pursuant to section 421.201(4), Wis. Stats., provides: "Chapter 427 of the Wisconsin Statutes applyies to any debt collection activity in this state, including debt collection by means of mail or telehone communications directed to consumers in this state."
We have been contacted by ..., Wisconsin, concerning debt collection calls from 500FastCash to her place of employment, apparently regarding a payday loan made with your company online. .....most recent e-mail on this issue is below .... also forwarded to us copies of letters she states were emailed to 500FastCash requesting that it cease calling her at the job. A Zip file of those letters is attached to this e-mail for your reference, as well.
Please be advised that section 427.104(1)(g), Wis. Stats. , prohibits collection communication that can reasonably be expected to threaten or harass the customer. As it appears your company has failed to honor ...... written requests for no collection calls at the workplace, we would consider your company's continued calling of the customer at the workplace to be a violation of that section. The statutes provide that a violation of that section is subject to the remedy set forth in section 425.304, Wis. Stats., which states:
"A person who commits a violation to which this section applies is liable to the customer in an amount equal to the greater of:
(1) Twice the amount of the finance charge in connection with the transaction, except that the liability under this subsection shall not be less than $100 nor greater than $1,000; or (2) The actual damages, including any incidental and consequential damages, sustained by the customer by reason of the violation."
We request that 500FastCash respond to the allegation that it has violated section 427.104(g) of the Wisconsin Statutes, and that we be advised of any proposed remedy to the consumer for the indicated violation, within 15 days. Your assurance that all collection calls to ...... workplace have ceased is also requested.
We also wish to advise you that 500FastCash must file the Wisconsin Consumer Act registration required by section 426.201, Wis. Stats. The initial registration form can be accessed here:
