i lost my job and wasnt able to pay the loan back i got a call from a guy name brad with National Attorney collection services sayin that i have a LEGAL CASE IN THERE OFFICE AND IF I DONT PAY 720.00 IMMEADIATLY i was goin to be charged wit check fraud and would get 2years probation and would have to take some type of classes at the time i took out the advanvce i was living in delaware .could i really go to jail or be charged with a crime please help me im terrified. :cry:

To help you out, we need a little more information.

Since you listed a website, I'm assuming that this is an internet based loan?

Also, have you paid anything back at all on this loan?

And was it an actual payday loan or an installment loan?

Those things will help us provide you the right advice.

Your state does not specifically prohibit criminal action against someone who defaults on a payday loan, but in other states, you can't be arrested for defaulting on a loan. However, if the lender is licensed in your state and is doing business legally, they can take you to court and obtain a judgement against you if you don't pay. Not trying to scare you here, just trying to make you aware of things that might happen.

Is there any way you can get a part time job or something in the near future to pay this off? The sooner you have this monkey off your back, the better.

Just a quick update - I did a search of the Delaware Licensee database, and this company was not listed under "cashin30minutes.com". Is it possible they operate under a different name (many payday lenders do).

Do you have any paperwork or did you print out anything from their website that shows their true company name? I don't want to just say "they're not licensed" without doing more in-depth checking under another company name. Delaware's law is horrible - it offers practically no protection for the consumer - it's very heavily padded towards the lender.
